Motion carried unanimously (5-0). <br /> (It was Council's understanding the t work shall commence in six . <br /> (6) months and be concluded within one (1) year ( City Code Sec- <br /> tion VIII, D (h)) . <br /> Case No. 79-20, Review of Special Use _P e rm.!.Li2..L..?..!~n and Home <br /> Occupation - 16~~~~st HighwaL_~_ <br /> , Miller explained that the three year review of this Special Use <br /> Permit for a Bohemian Cue Service home occupation was required to <br /> see if the home occupation is compatible with the orderly devel- <br /> opmen t of surrounding land, which is the intent of the ordinance. <br /> Miller reported that he is not aware of any complaints and there <br /> has been no evidence of flagrant abuses of the home occupation; <br /> explained tha t the sign is part of the Special Use Permit, even <br /> if it does not meet the CUTrent sign requirements; reported that <br /> the sign has not been changed significantly (except perhaps the <br /> wording) sin ce the SUP was granted. <br /> In discussion, it was noted by the applicant, Paul Rutter, that <br /> he now opens the service at noon and closes at 7:00 p.m. ; stated <br /> the operation is very much the same as it was, except that it is <br /> now his sole means of support. <br /> McAllister moved, seconded by Hicks, that Council extend the <br /> Special Use Permit for the cue service home occupation. Motion <br /> carried unanimously (5-0) . <br /> (It was Council's understanding that the Special Use Permit will <br /> now be continuous un t i 1 such time as the special conditions are <br /> violated or the use specifically permitted is changed) . <br /> Siren Test <br /> Miller reported that NSP has completed its work on the siren; a <br /> faulty fuse was the reason the siren co u 1 d not be activated pre- <br /> viously. Miller said another tes t time can now be scheduled, or <br /> it could be tested at 1: 00 p.m. on the scheduled fi rs t Wednesday <br /> of November. <br /> Council concurred tha t the siren tes t be announced to coincide <br /> with the general 1:00 p.m. Wednesday sire n test in November. <br /> Cardiac Pacemaker's Request - ~eplacement of Trees and Shrubbery <br /> Counc i 1 was referred to McNiesh's me.mo of Octoher 8th relative to . <br /> Cardiac landscaping. Mi ller said tha.t from the standpoint of <br /> public benefit, and the fact that Cardiac has planted more trees <br /> and shrubs than indicated on the approved landscape plan, he <br /> feels the damaged or destroyed trees need not be replaced, ex- <br /> cept along the north property line, where he sugges ts that 3+ <br /> overs tory trees be planted to screen the parking from residental <br /> area to the north.
