Planning Case #96-01. Amble Final Plat and Variance. 1211 West Amble Road <br /> <br />Mr. Ringwald reported to the Council that the applicant is requesting approval of a final plat <br />consisting of four lots on a 2.99 acre parcel zoned R-1 Single Family Residential District. He <br />stated the request also includes a variance to allow the use of a private drive rather than a <br />public street. <br /> <br />Mr. Ringwald stated the Planning Commission recommended approval of the preliminary <br />plat on March 6, 1996, and was approved by the Council on March 25, 1996 based on the <br />following conditions: <br /> <br />1. Provision of the required driveway easement prior to final plat approval; <br /> <br />2. Provision of adequate sediment and erosion control measures; <br /> <br />3. Payment of the appropriate park dedication fee; <br /> <br />4. Provision of a driveway which is consistent with the requirements of the Fire <br />Code; and <br /> <br />5. Provision of signage at the southerly edge of the driveway (West Amble Road) <br />which identify the addresses located on the private driveway. <br /> <br />Mr. Paul Amble, 1209 West Amble Road, read into the record the attached letter to the <br />City Council, expressing the family's objection to the required six percent park dedication fee. <br /> <br />Mayor Probst stated he understood the applicant's position, but stated that once the final plat <br />is approved, the lots created are lots of record and could be sold. He stated that historically <br />park dedication has consistently been applied to lots based on six percent of their value, and <br />that is how the park dedication fee has been determined for these lots. <br /> <br />Councilmember Hicks stated he agreed with Mayor Probst that the policy has been uniformly <br />applied. <br /> <br />Councilmember Aplikowski inquired when park dedication fees are due and payable when no <br />money is being transferred as in this case. Mayor Probst replied that park dedication fees are <br />payable before a building permit is issued. <br /> <br />Mr. Amble stated that only one home will be built at this time, as the other home has not <br />been planned as of yet. <br />
