Mr. <br />Stonehouse advised the assessment would be reduced by 28% to 30%. Mayor Probst stated he <br />would support this revision since the easement reduces the buildable or developable area of that <br />lot. <br /> <br />Councilmember Malone reviewed the reductions as proposed by staff and asked if the Herbst <br />property assessment would be calculated on square footage with a 100 foot depth. Mr. <br />Stonehouse used an overhead to diagram the alignment of the utility right-of-way and stated it <br />could be calculated as an odd-shaped lot. Councilmember Malone concurred with the suggestion <br />to calculate the assessment without the easement square footage included. <br /> <br />Mr. Filla advised the Assessment Policy indicates the City may reserve the right to remove land <br />if located within an easement and determined it cannot be developed in the future. <br /> <br />MOTION: <br /> <br />Malone moved and Aplikowski seconded a motion to deny the appeal of <br />Resolution No. 96-36 of two parcels set aside at last meeting; move to accept the <br />appeal of Virginia Roach, 1628 Oak Avenue, and adjust the foot footage to <br />148.75; and deny the appeal of James D. Johnson, 1535 Lake Johanna Boulevard, <br />because benefit is properly assessed. The motion carried unanimously 4-0. <br /> <br />MOTION: <br /> <br />Malone moved and Aplikowski seconded a motion to accept the appeal of <br />Resolution No. 96-34 by Ronald Christianson, 1438 Arden Oaks Court, to Pascal <br />Avenue and adjust front footage to 38.5 feet; with Ronald Christianson, 1438 <br />Arden Oaks Court, to adjust for footage on Arden Oaks resurfacing to 47.44 feet; <br />with Eugene D. Schmidt, 1628 Chatham Avenue, and David Barnier, 1624 <br />Chatham A venue, to deny the appeal of assessments to those two properties since <br />they are properly assessed; with Steven and Carol Herbst, 3799 McCracken Lane, <br />to accept their appeal and direct the City Engineer to recalculate the assessment <br />and deduct the square footage of the triangular section between the sewer <br />easement and lot lines and adjust the assessment accordingly; and with Rhonda <br />Behr, 1401 County Road E, to deny her appeal and find that property is properly <br />assessed at 103.5 feet. The motion carried unanimously 4-0. <br /> <br />MOTION: <br /> <br />Aplikowski moved and Keirn seconded a motion to adopt Resolution No. 96-34a, <br />Adopting Final Assessment Roll (5 Years Amortization) For Parcels 20,33,34 <br />and 38 ofthe Reconstruction Improvements Project; and Parcel 46 of the <br />Bituminous Overlay Project. The motion carried unanimously (4-0). <br />
