Resolution #96-45 Authorizing Condemnation of Street, Utility and Drainage
Easements in Connection with Oak Avenue Reconstruction

Mr. Filla, City Attorney, explained that in order to reconstruct Oak Avenue, it may be necessary
to acquire easements over property owned by Marjorie Asbbach and Richard and Janet Shepley.
He further eXplained that he is working with the City Engineer to negotiate with these residents
to acquire the necessary easements but, as yet, negotiations have been unsuccessful. Therefore,
he recommends the Council authorize commencement of condemnation proceedings to acquire
these needed easements over the Ashbach and Shepley properties to avoid unreasonable delay in
the reconstruction of Oak A venue in the event negotiations remain unsuccessful.
