ARDEN HILLS CITY COUNCIL — SEPTEMBER 8, 2025 2 <br />Councilmember Holden indicated she has received questions from residents on why the recent <br />City newsletter did not address why the PDA lapsed with Alatus. She believed that transparency <br />on this point would benefit the City. <br />Councilmember Monson explained this was a sensitive topic because there was an ongoing <br />lawsuit. She noted there was significant discussion surrounding whether or not to extend at the <br />last JDA meeting. She reported in the end after two years, the JDA was not seeing progress and <br />the County could not get to a purchase and sale agreement with Alatus. <br />Councilmember Weber commented that the PDA lapsed because the contract expired on June <br />30, 2025. He explained the JDA through the lack of action opted not to extend the contract. <br />Mayor Grant reported the contract gave the developer exclusive rights to negotiate and this <br />contract lapsed. He stated there was now no developer that had an exclusive right to develop the <br />California parcel. <br />City Administrator Jagoe reported the preliminary development agreement (PDA) had an <br />expiration date of June 30, 2025 and with the JDA taking no action to extend this agreement, the <br />agreement terminated on its own on June 301n <br />3. Transportation Update <br />Public Works Director Swearingen reported the road just south of the DMV will be closed <br />while the contractor constructs the watermain interconnect. He explained the road closure was <br />expected to begin on Monday, September 15 and should last one week. <br />Public Works Director Swearingen stated the Lift Station 5 forcemain work would begin on <br />Wednesday, September 10. He noted County Road E would be closed during this work which <br />would take two to three weeks and a detour would be put in place. <br />Councilmember Holden stated the on/off ramp onto 35W by Cleveland Avenue was closed. <br />7.
