Their proposal includes removing 128 caliper inches of <br />significant trees due to the relocation of the building footprint and driveway access to a currently <br />landscaped portion of the Subject Property. The Applicant acknowledges that approximately 46 <br />caliper inches of replacement trees would be required for replanting in accordance with city code. <br /> <br />As part of their variance request, the Applicant indicates that they agree to meet the requirements <br />of Section 1325.055 and are open to an approach that includes one or a combination of the <br />following: counting preserved trees towards the required landscaping plan, replanting the required <br />replacement trees on-site, or contributing a landscaping fee in lieu of planting. The proposed plans <br />would meet requirements. <br /> <br />3. General Regulations (Requirements for Parking, Loading, and Circulation) – Section <br />1325.06 <br /> <br />Parking and Driveway Requirements – Meets Requirements <br />Section 1325.06 is applicable to the review of the Applicant’s proposal as the request includes <br />removing the existing curb cut from County Road E and creating a new curb cut for a driveway <br />with access to Pascal Avenue. County Road E is a county road and defined as a collector road <br />while Pascal Avenue is a city road and defined as a local road. Per the Zoning Code, single family <br />dwellings are required to provide two (2) off-street parking spaces and all off-street parking spaces <br />shall have access driveways and access directly to public streets. Any residential lot, which has <br />frontage on both a local street and a collector street shall gain access only from the local street. <br /> <br />The Applicant’s proposal would remove a collector street curb cut and access driveway and <br />relocate the Subject Property’s access driveway to the local street, bringing the Subject Property <br />into compliance with the code requirements for a residential lot drive access. <br /> <br />4. Variance Review <br /> <br />The role of the Planning Commission is to determine and consider how the facts presented to them <br />compare with the city’s articulated standards. The Commission should base their decision on the <br />facts presented and then apply those facts to the legal standards contained in city ordinances and <br />relevant state law. Neighborhood opinion alone is not a valid basis for granting or denying a <br />variance request. While the Planning Commission may feel their decision should reflect the overall <br />will of the residents, the task in considering a variance request is limited to evaluating how the <br />variance application meets the statutory practical difficulties factors.
