<br />Page 4 of 8 <br />added as an allowed use within the B-2 Service Business Zoning District, the underlying zoning <br />district of the Subject Property. For Arden Plaza, as a PUD, the basic underlying zoning district <br />establishes the allowable uses and the general standards for the Arden Plaza development and the <br />approved PUD plan establishes the specific regulations for development and shall govern and take <br />precedence over the underlying Zoning District regulations. <br /> <br />The Arden Plaza PUD establishes retail sales as the permitted use for Building #5. Due to this <br />language in the PUD Development Agreement, a PUD Development Agreement Amendment is <br />required to allow for other uses at the Subject Property. The Applicant is proposing an amendment <br />to the PUD Development Agreement to allow for a Class I thrift store use within Building #5 of <br />the PUD. <br /> <br />The Applicant’s request is subject to Section 1320 District Provisions, Section 1325.046 Thrift <br />Store Additional Criteria, and Section 1305.04 Definitions. <br /> <br />Plan Evaluation <br /> <br />Chapter 13, Zoning Regulations Review <br /> <br />1. District Provisions (B-2 Service Business District) – Section 1320 <br />Under the 2040 Comprehensive Plan, this site is guided as Retail Mixed Use on the land use plan <br />and is zoned B-2 Service Business District. Thrift Store, Class I is a permitted use within this <br />district. No changes to dimensional standards are proposed and the approved standards in the <br />original PUD and subsequent PUD Amendments remain in effect. <br /> <br />2. Thrift Store Additional Criteria – Section 1325.046 <br />Thrift stores are allowed as either permitted or conditional uses depending on the characteristics <br />of the operation. All thrift stores shall comply with the following conditions: <br /> <br />a. All merchandise sorting, processing, and storage shall occur within a completely enclosed <br />principal structure. <br />The Applicant states the majority of Odds & Ends Again sorting is done off site at clients’ <br />homes as part of the moving and packing services. The store location does not have any <br />sorting bins or large dumpsters for rubbish disposal. <br /> <br />b. No exterior storage or the use of exterior storage containers or semi-trailers for storage shall <br />be allowed upon the site. <br />The Applicant states Odds & Ends Again does not have exterior store containers. In the <br />Applicant’s narrative, it is noted that the business utilizes two small moving vans. As <br />described, the two vans are not always located at the Subject Property and that <br />sometimes the vans are stored at other locations, with their drivers, or at their Apple <br />Valley Location. <br /> <br />The Applicant has stated that they will comply with the no exterior storage requirement <br />and staff will work with the applicant to further demonstrate and verify that the moving <br />vehicles are not utilized for exterior storage on the site. The Planning Commission may <br />consider drafting a condition of approval related to exterior storage to be brought <br />forward with its recommendation to the City Council. <br />
