Page 7 of 14 <br /> <br />which are below the minimums required in the R-1 Zoning District and Shoreland District. <br />Therefore, a variance is requested for lot depth and area. <br /> <br />Building Area Elevation – Variance Requested <br />In addition, for lots abutting upon a watercourse, drainage way, channel or stream, including <br />wetland or marsh, all building areas should be located outside the natural feature and a minimum <br />of two (2) feet above the 100-year flood elevation. <br /> <br />With regards to elevation for building areas, the Subdivision ordinance references the 100-year <br />flood elevation and the Subject Property, a riparian lot on Lake Johanna, is subject to the regulatory <br />floodplain for the waterbody. As part of the Rice Creek Watershed District (“RCWD”) review of <br />the proposed plans, a RCWD representative provided the 100-year regulatory floodplain elevation <br />for Lake Johanna, which is 881.1. <br /> <br />The proposed building area is shown to be located outside of the natural feature, Lake Johanna, <br />and the survey with the proposed new dwelling shows a minimum elevation of the building area <br />is 881 feet, which is approximately the 100-year regulatory floodplain elevation for Lake Johanna. <br />The proposed elevation does not meet the minimum building area elevation of at least two feet <br />above the 100-year flood elevation. A RCWD representative noted in their review that permitting <br />is required for floodplain alteration as it relates to the new home construction. A variance is <br />required for the proposed building area elevation for the new dwelling. <br /> <br />Chapter 13, Zoning Regulations Review <br /> <br />1. District Provisions (R-1, Single Family Residential Zoning District) – Section 1320.06 and <br />Shoreland Regulations – Section 1330 <br /> <br />Lot Size and Dimensions – Variance Requested <br />The Subject Property after the proposed lot consolidation has a lot area of 8,372 square feet and a <br />minimum depth of 49 feet. Section 1320 and Section 1330 requires a minimum lot size of 14,000 <br />square feet per single-family dwelling unit and a minimum lot depth of 85 feet. The consolidation <br />of the two lots is statutorily required because of their size limitations and the two lots could not be <br />developed separately. The Applicant is seeking a variance for the proposed lot size and <br />dimensions. <br /> <br />Structure Setbacks – Variance Requested <br />In the R-1 District, the minimum front and rear setback requirements are 40 feet and 30 feet, <br />respectively. The minimum side yard setback in the R-1 District is 10 feet and 25 feet combined. <br />Additionally, Section 1330 – Shoreland Regulations requires a minimum structure setback from <br />ordinary high water level of 50 feet. The current principal structure encroaches 0.4 feet into the <br />Right-of-Way as measured from Lake Johanna Blvd and has a 9-foot setback as measured from <br />ordinary high water level. The proposed new dwelling and attached garage would be located <br />entirely on the Subject Property, with a front yard setback of 0.3 feet. Rear yard setbacks would <br />be 8.5 feet from the proposed deck and 10.9 feet from the proposed principal structure, as measured <br />from ordinary high water level. Variances are required for the proposed front yard and rear yard <br />setbacks. <br /> <br />The existing side yard setbacks are 14.9 feet and 15.4 feet, for a combined total of 30.3 feet. The <br />proposed side yard setbacks are 22.1 feet as measured from the principal structure to the northeast <br />property line and 24.7 feet as measured from the deck to the southwest property line, for a total of
