Subd. 3. Miscellaneous. Other information as required by the City Administrator. <br />• 328.06 Review of Permit Application <br />Within thirty (30) days of receipt of a completed application, the City Administrator shall <br />make recommendations to the City Council for Approval or Denial of the Permit. The <br />City Council shall take final action within thirty (30) days of receipt of the <br />recommendations of the City Administrator. The City may attach conditions to the <br />permit which address the following items: <br />Solid. 1. Easement. Dedication of an easement to the city for any permanent erosion and <br />sediment control practice(s) that remain after the Land Disturbance Activity is <br />completed. <br />Subd. 2. Maintenance. Responsibility for the Maintenance of the permanent erosion and <br />sediment control practices for the period of the Land Disturbance Activity, in, if <br />necessary, thereafter. The City shall assign the maintenance responsibility for a <br />permanent erosion and sediment control practice after that time. <br />Subd. 3. Escrow Requirement. The escrow of a sum of money sufficient to insure the <br />installation, completion and maintenance of the Erosion and Sediment Control Plan and <br />Practices. <br />is <br />328.07 Modification of Plan <br />An approved Erosion and Sediment Control Plan which has been approved as part of the <br />permitting process may be modified upon submission of an application for modification <br />to the City Administrator. A request for an Erosion Control and Sediment Plan permit <br />modification shall be processed in the same manner as the original permit and the City <br />may require additional reports and data. <br />838.08 Variance <br />In the case of restrictive site conditions or emergency situations, the developer may apply <br />for a variance from the provisions of this regulation. The variance must be approved by <br />the District Board and by the City. The City shall submit the variance request to the <br />District Board for review. The variance shall be approved or denied by the City and by <br />the District Board within sixty (60) days after receipt of the variance request. Where the <br />recommendation of the District Board differs from the recommendation of the City, the <br />recommendation of the District Board shall prevail. <br />328.08 Multi -Jurisdictional Projects <br />When a road construction project crosses municipal boundaries, Ramsey County or <br />Minnesota Department of Transportation shall obtain an Erosion and Sediment Control <br />• Plan permit from the appropriate water management organization(s) rather than <br />individual cities. <br />328-5 <br />
