Round Lake Road
Arden Hills MN 55112
RE: Metricom Agreement
City of Arden Hills
PF&B File No. 10450.000001
Dear Joe:
I have reviewed the Right-of-Way Permit and Facility Use Agreement which was drafted by
• Metricom, the League of Minnesota Cities and the Suburban Rate Authority. The Agreement
is in proper legal form.
Please refer to Section 6.2 entitled "Limitation of City's Liability". This kind of paragraph
normally is tied into the maximum limits contained in the Municipal Tort Liability Act.
However, in this case I am assuming that the issue was reviewed by the League of Minnesota
Cities and this language was acceptable. In any event, the dollar value of the radios which
would be attached to light poles within the City of Arden Hills is such that the City's current
liability policies would apply with adequate coverage even if the City were determined to be
responsible in some manner for negligence.
If you have any questions, please contact me.
Very tr ours,
J( IEEme .
