• VIII. HARDSHIP DEFERRALS <br /> Minnesota Statute No. 435.193 allows the City, at its own discretion, to 5 <br /> defer the payment of any assessment for any homestead property owned by a <br /> person 65 years of age or older or retired by virtue of a permanent and <br /> total disability for whom it would be a hardship to make the payments. <br /> In order to receive such a deferment, the affected person must establish <br /> the economic hardship that would be incurred to the reasonable satis— <br /> faction of the Arden Hills City Council by providing documentation <br /> showing an annual adjusted gross income less than $14,000. The deferral <br /> will last for a period of not more than ten years and will terminate <br /> before ten years if any one of the following conditions is present: <br /> a. ) the Owner of the property dies and the spouse is not eligible for a <br /> deferment <br /> b. ) the property is sold <br /> • c. ) the property is no longer homestead • <br /> d. ) the City Council determines that there is no longer hardship <br /> incurred in immediately requiring either full or partial payment of <br /> the assessment. <br /> The City reserves the right to periodicially request verification of <br /> continued eligibility for a hardship referral . <br /> This deferment must be made by either adoption of an ordinance or a <br /> resolution. An application for deferment of special assessments is <br /> provided in the Appendix of this Assessment Manual . Also provided in the . <br /> Appendix is a sample resolution approving an assessment deferment and an <br /> application for delayed payment of tax on special assessments for senior <br /> citizens ' homestead property. <br /> • <br /> 38 <br />
