Miller identified three wetlands, one <br />on the Keithson site and two on the adjacent site; noted that surface drainage <br />is proposed to be ponded on west side of site. <br /> <br />Miller reported that the Planning Commission recommends approval of the <br />Preliminary Plat, with a temporary on-site or off-site turn-around at the end <br />of the road, subject to approval of drainage and grading by RCWD and City <br />Engineer, approval oX utilities plan by City Engineer and approval of <br />turn-around by Fire Chief and City Public Works Department. <br /> <br />. <br /> <br />Marcel Eibensteiner explained that the property owners (Lawyers) will retain <br />lots 1 and 2, block 1. Eibensteiner asked Council if he can hire City Engineer <br />for his engineering and inspection needs in the development of Keithson <br />Addition; explained that he plans to develop the site under a private contract. <br />Eibensteiner said he proposes to enter into an agreement with the adjacent <br />property owner to build the temporary turn-around on an easement south of <br />Keithson Addition; said if he can't obtain the easement, he will construct an <br />80' diameter temporary cul-de-sac on site. <br /> <br />Hicks moved, seconded by Peck, that Council approve the Preliminary Plat of <br />Keithson Addition, subject to: <br />1. Provision of a temporary cul-de-sac or hammerhead turn-around at the <br />end of the street, on or off the site. <br />2. Approval of grading and drainage by City Engineer and Rice Creek <br />Watershed District. <br />3. Approval of utilities plan by City Engineer. <br />4. Approval of turn-around by Fire Chief and City Public Works <br />Department. <br />5. Approval of appropriate Development Agreement by City Attorney. <br />6. Satisfaction of Park Dedication prior to issuance of building permits. <br /> <br />Motion carried unanimously. (5-0) <br /> <br />Hicks moved, seconded by Peck, that Council approve Keithson Addition <br />engineering by SEH; City to bill developer for costs incurred by the City. <br />Motion carried unanimously. (5-0) <br /> <br />Case No. 86-9, Sideyard Setback Variance - Dan Ashbach. 1567 Oak Avenue <br />Miller referred Council to a transparency of the Ashbach properties at 1567 and <br />1569 Oak Avenue; explained that the applicant is requesting approval to build <br />an addition to his existing house at 1567 Oak Avenue; noted that as proposed a <br />sideyard setback variance is required. Miller noted the approximate 30 foot <br />separation between the houses on the two lots (both owned by the applicant); <br />reported that it is the appl~cant's intent to retain the secondary house <br />temporarily and eventually remove it and combine the two lots. <br /> <br />Miller reported that the Board of Appeals recommends denial of the variance <br />because location of addition is the applicant's personal desire; there are <br />alternatives which could be considered. Miller explained that the applicant <br />has looked at alternatives and does not find them to be realistic. <br /> <br />. <br /> <br />Miller reported that the Planning Commission supports the variance if a <br />covenant is placed on the two lots restricting the sale of either lot <br />separately and combining the lots into a single parcel when the secondary house <br />(1569 Oak Avenue) is removed. <br /> <br />Applicant Dan Ashbach referred Council to a petition, signed by surrounding <br />neighbors, approving his proposed plans. Robert Ashbach spoke in favor of his <br />son's request for a variance; noted that it was his understanding, as Mayor of <br />Arden Hills, that variances are intended as a vehicle to allow property owners <br />reasonable development of their property and resolve real problems, without <br />causing any negative impact on neighboring properties; feels their's is a <br />reasonable request. <br /> <br />Woodburn read a letter from Ashbach's attorney outlining the covenant which <br />could be placed on the lots restricting the sale thereof as a single parcel <br />and, subsequent to the demolition of the secondary house, combination of the <br />two lots into one lot. <br />
