---
.
I
United States Department of the Interior I
BUREAU OF INDIAN AFFAIRS
Washington, D.C. 20240 OEe 1 9'QC, I
'......J"
IN REI'LY REFER TO:
.ij.
I
Honorable Bruce F. Vento NOV 0 6 1995 I
House of Representatives
Washington, D. C. 20515-2304
Dear Mr. Vento: I
Thank you for your letter dated October 16, 1995, regarding your concerns for the I
future uses of the Twin Cities Army Ammunition Plant (TCAAPI and your support of
the Reutilization Committee's resolution.
The Bureau of Indian Affairs (BIA) will not support a request from a federally I
recognized Indian tribe for acquiring Federal "excess' real properties for Indian gaming I
purposes. The BIA does not have the authority to acquire "excess' real properties for
use by an Indian tribe pursuant to the Indian Gaming Regulatory Act. The BIA would
consider a request from the Prairie Island Community Council (Tribe) if the property -.
will be used in the performance of Tribe's contract and/or grants awarded pursuant
Public Law 93-638, the Indian Self-Determination and Education Assistance Act. The
Prairie Island Community Council (Tribe) may purchase property at the TCAAP I
through a "negotiated sale' at the "surplus' level pursuant to the Federal Property and
Administrative Services Act of 1949.
My staff also met with the Tribe and informed them of the Federal "excess' and .
f< "surplus' processes. If the Tribe plans to purchase land at the TCAAP, the BIA does
not have the authority to impose restrictions on how the Tribe will expend their tribal ,
income resources.
If you should have further questions regarding this matter, please contact Ms. Ruth I
Smith at (202) 208-2521.
Sincerely, ,
/s/ Janes H. McDivitt ,
Acting Director, Office of Management ,
and Administration
-,
I
