Walsh, Parks & Recreation DirectorC>' <br /> SUBJECT: Considerations of Trail Development <br />I Background <br />I On January 8, 1996 Council approved Resolution 96-05 authorizing the plans and specifications <br /> for the 1996 Trail Development Project. Along with the main segment of trail, two alternate <br /> segments will also be bid. If bids received are competitive, I may ask Council to consider <br />I developing an additional segment, which could be more the budgeted expenditure from the Park <br /> Fund. <br />I 1. Wetland Area Considerations <br /> As you are aware from our discussions at the Council worksession on November 16, <br /> 1995, the trail easement east of John McClung's new development contains wetland <br />.. areas. MSA is in the process of having one of their staff members delineate the wetland <br /> area. City staff has been in contact with the Rice Creek Watershed District with regards <br />I to our options for trail development. <br /> At this time, any project requiring the removal and fill of more than 400 square feet <br />I requires mitigation. The trail distance through the wetland is less than 1000 square feet. <br /> However, there has been some discussion that the legislature is considering a change <br /> from 400 square feet to 1000-2000 square feet. In the event that legislation is changed, <br />I we would be able to construct a trail through the area, without mitigating. <br /> Recommendation <br />I Since staff is unsure of what legislation will occur in the area of wetland laws, <br /> staff would recommend that the project include removal and fill to create an 8 foot <br /> bituminous trail through the wetland. When trail construction occurs in May, staff <br />I would have the benefit of any recent legislative changes and can develop the trail <br /> accordingly. <br />I <br />I <br />I' <br />I <br />
