<br /> I <br /> I R-2 Zoning District requires single family lots to be at least 85 feet in width, 120 <br /> ~ feet in depth, and contain 11,000 square feet in area. The petitioners property <br /> exceeds the R-2 Zoning District Requirements, in terms of; lot width, depth, and <br /> area. However, the property is adjacent to Lake Johanna and therefore has a 75 <br /> foot rear yard setback versus the 30 foot rear yard setback that non-riparian lots <br /> I have. <br /> 2. Terrain. The property is steeply sloped from Sandeen Road down to Lake <br /> I Johanna. The property drops approximately 34 feet from the road to the lake. <br /> The variance which was granted to the McCloskey property (3290 Sandeen Road <br /> - Planning Case 87-09) was based primarily on the steep topography in this area. <br /> I " Reasonable Use. The property currently contain an existing structure. The <br /> ~, <br /> I existing structure is a legal non-conforming use and subject to Section IX of the <br /> Zoning Ordinance. <br /> I The properties in the adjacent area typically do have front yard setbacks which are <br /> less than the required 40 feet. As previously mentioned the McCloskey property, <br /> which is to the North of the applicant's, has received a variance which placed that <br /> I front yard setback at 35 feet. Also, the structure (legal nonconforming) to the <br /> South of the applicant's (3260 Sandeen Road) has a front yard setback of <br /> approximately 35 feet. <br /> .. 4, Economic Conditions. The application did not contain any evidence of an <br /> economic hardship. <br /> I D. Planning Commission Recommendation <br /> The Planning Commission recommends approval of a five (5) foot front yard variance in <br /> I Planning Case 96-02, based on the property's steep topography and the prevailing front <br /> yard setback on the adjacent properties, the recommendation is subject to the following <br /> condition: <br /> I 1.
