The applicant has informed Staff that they will only be selling Tract C immediately. A <br /> family member (Geruth Buetow) is going to purchase and move into the existing home (1433 <br /> Forest Lane). Tracts A and B will be retained by Ms. Buetow into the foreseeable future. <br /> Therefore, the wording of conditions 8 and 9 should be reviewed, since these conditions may not I <br /> be enforced for a considerable period of time. The Staff is concerned about tracking these <br /> conditions over a decade or more of time. <br /> The Staffhas discussed with the applicant the possibility of withdrawing the RLS and just selling I <br /> Lot 18, as it is an existing platted lot of record. The status of the house and its relationship to <br /> Lots 16 and 17 could be re-evaluated at some point in the future when the family no longer had a I <br /> need for the home or the two lots which contain it. The Staff also discussed with the applicant <br /> the possibility of modifying the final RLS by combining Tracts A and B into a single Tract. The <br /> applicant wishes to have the City Council act on their request as submitted (Exhibit B). I <br /> The Staff has also investigated the potential of combining the two Tracts into one tax parcel, <br /> after the RLS has been filed, If City Council approval is required to split two properties of I <br /> record back into two tax parcels, then this could provide an additional means for enforcing <br /> conditions 8 and 9, However, Ramsey County officials in the Recorders Office and the Property I <br /> Valuation Office both confirmed that City approval would not be required to split two properties <br /> of record from one tax parcel into two tax parcels. <br /> If the City Council perceives that the tracking of conditions 8 and 9 is substantive issue, then the .. <br /> City Council may wish to discuss the language ofthese conditions and consider possible <br /> modifications to this language. I <br /> Park Dedication <br /> The Director of Parks and Recreation has reviewed the valuation of Tracts B and C and has . <br /> recommended a park dedication fee for the City Council's consideration (Exhibit C), The <br /> recommended park dedication fee is $8,085.00, and can be broken down as follows: <br /> Tract Park Dedication Fee I <br /> Tract A $0 I <br /> Tract B $3,990.00 <br /> Tract C $4,095.00 I <br /> Recordin~ ofRLS I <br /> The City Code (Subdivision Ordinance) in Chapter 22-4, (b), (4), states in relevant part:"Ifthe <br /> final plat is approved by the city council, the subdivider shall record it with the county recorder I <br /> or registrar of titles within sixty (60) days after the date of approval; otherwise, the approval of <br /> the final plat shall be considered void". If the City Council approves the final RLS on Monday, <br /> May 13, 1996, then the approval of the final RLS would become void on Friday, July 12, 1996. -. <br /> I <br /> ! <br />
