He inquired if there was <br />I interest in land dedication by the Parks Commission. Mr. Ringwald replied that the Comprehensive <br /> Plan did not show additional park land in this area, and Cindy Walsh, Director of Parks and <br /> Recreation, stated that there is ilO need for additional access to this area of Cummings Park. <br />I Piotrowski moved, seconded by Larson, to approve Planning Case #96-10, subject to the <br /> conditions contained in the Planner's memorandum. The motion carried unanimously (7-0). <br />I PUBLIC HEARING CASE #96-06 HERB TOUSLEY 3248 SANDEEN ROAD FRONT YARD <br /> V ARlANCE <br />I Chair Erickson opened the public hearing at 7:47 p.m. <br />I Mr. Ringwald verified the public hearing notice was published in the Focus on May 23rd and <br /> 30th, 1996. <br />I Mr. Ringwald stated the applicant is requesting approval of a variance from the required front and <br /> side yard setbacks. He stated the front yard setback being requested is 35 feet, when 40 feet is <br />.. required, and the requested side yard setback varies from 2.7 feet to four feet, when five feet is <br /> required. <br />I Mr. Ringwald stated the applicant is requesting the variance so the front yard of the property will <br /> have a similar building setback from Sandeen Road as the adjacent properties. He stated the <br /> applicant is requesting the side yard setback variance due to the fact that the existing structure is <br />I currently non-conforming in respect to the side yard setback and the proposed addition would require <br /> the extension of that non-conforming wall. <br />I Mr. Ringwald stated the City approved a similar front yard variance request in 1987 for Candace <br /> McCloskey at 3290 Sandeen Road, which provided for a 35-foot front yard setback when a 40-foot <br />I setback was required, based on the prevailing setback in the area and slope to the lake., He stated a <br /> side yard variance request was also approved in 1994 at the Lundgren home at 3487 Ridgewood <br /> Road, which essentially extended an existing nonconforming wall. Mr. Ringwald stated the property <br />I is steeply sloped from the home down to Lake Johanna, and that several mature hardwood trees <br /> would have to be eliminated if the addition was to be located on the south side of the property. <br />I Mr. Ringwald stated that staff recommends approval of the front yard setback variance based on the <br /> previously described steep topography, prevailing front yard setback in the area, and previously <br /> granted variances in the area of a similar nature. He stated staff recommends approval of a side yard <br />I setback variance as shown on Exhibit A, page 1 of3 ofthe June 5,1996, memorandum, based on <br /> the wall to be extended does not augment a building nonconformity and also based on a previously <br />it granted variance, subject to the following condition: <br />I <br />
