Parking for Parcels A-I and C shall be determined to have a current surplus of 171 I <br /> parking spaces and Parcel A-2 shall be determined to have a current surplus of 41 parking <br /> spaces. Also, the row of parking stalls adjacent to Fernwood Avenue shall be eliminated -- <br /> and replaced with landscaping prior to any further site plan approvals are granted on <br /> Parcels A-lor C. The landscaping is to be reviewed by the Planning Commission and <br /> consideration for approval by the City Council. The landscaping shall receive approval I <br /> by the City; <br />6. Park dedication for land shall be granted and/or fees in lieu of dedication shall be <br /> determined by the City Council after consideration and recommendation by the Parks and I <br /> Recreation Committee; <br />7. Signage along Lexington A venue shall be limited to the current level of signage, all other <br /> signage shall be governed by the requirements of the Sign Code; I <br />8. Architectural Design shall be consistent with the applicants description on Exhibit A, <br /> page 5 of21 and the requirements of the City Code, whichever is greater; <br />9. Skyway from the CDC campus (southwest part) and the CPI campus is acceptable, I <br /> subject to City review and approval of the construction, aesthetics, and distribution of <br /> liabilities of the skyway; <br />10. Utilities shall be governed by the rules and regulations applicable at the time of review; I <br />11. The East-West private street between Parcels A-I and B should not be dedicated as a <br /> public street (collector); and I <br />12. Parcel B shall be analyzed by itself in relationship to the land development parameters <br /> and that those parameters shall not be flexed from what the City Code allows.; <br />The Planning Commission recommends approval of Planning Case 96-05, preliminary minor .. <br />subdivision, subject to the following conditions: <br />I. Provision of the necessary drainage and utility easements, prior to Planning Commission I <br /> consideration of the final minor subdivision; <br />2. Provision of the necessary vehicular cross access easements, prior to Planning I <br /> Commission consideration of the final minor subdivision; and <br />3. Dedication and/or payment of the appropriate park dedication for Parcels A-2 and B, as <br /> determined by the City Council. I <br />Deadline for Agency Actions <br />The City of Arden Hills received the complete application for this request on May 2,1996. I <br />Pursuant to Minnesota State Statute the City must act on this request by Monday, July I, 1996 <br />(60 days), unless the City provides the petitioner with written reasons for an additional 60 day I <br />review period. The City provided written notice to the applicant on June 10, 1996 stating that the <br />review period would be extended an additional 60 days. The additional review period would <br />extend to Friday, August 30, 1996. The City may with the petitioners consent extend the review I <br />period beyond the Friday, August 30, 1996 date. Lastly, if the City denies the petitioners <br />request, "... it must state in writing the reasons for the denial at the time that it denies the <br />request.
