<br /> The applicant is requesting re-approval of a final Registered Land Survey (RLS) consisting of
<br /> three (3) Tracts on a 1.11 acre parcel zoned R-I Single Family Residential District (Exhibit A).
<br /> I Backg-round
<br /> The final RLS was originally approved by the City Council on April 3, 1996. The final RLS had
<br /> I to be recorded by Friday, May 31, 1996 or that approval would become void. The applicant ran
<br /> into some unexpected delays in recording the RLS, due to that the property is in an estate and
<br /> that the property is registered as Torren's property with Ramsey County and was unable to
<br /> Ie record the RLS by the required deadline. The applicant anticipates that if the RLS is re-approved
<br /> that they will be able to record the RLS by the middle of August of 1996.
<br /> I Recordin~ of RLS
<br /> The City Code (Subdivision Ordinance) in Chapter 22-4, (b), (4), states in relevant part: "If the
<br /> final plat is approved by the city council, the subdivider shall record it with the county recorder
<br /> I or registrar oftitles within sixty (60) days after the date of approval; otherwise, the approval of
<br /> the final plat shall be considered void". If the City Council approves the final RLS on Monday,
<br /> I July 29, 1996, then the approval of the final RLS would become void on Friday, September 27,
<br /> 1996.
<br /> I Recommendation
<br /> The Staff recommends that the final Registered Land Survey be re-approved in Planning Case
<br /> 95-23, subject to the original conditions of approval, which are:
<br /> . I. Provision ofthe appropriate utility and drainage easements documents for review by the
<br /> City Attorney and approval by the City Council;
<br /> I 2. Recording of the utility and drainage easement documents with Ramsey County with the
<br /> RLS;
<br /> 3. Provision of a temporary rock construction entrance, as described in Exhibit C of the
<br /> I Staff memorandum (dated February 7,1996);
<br /> 4. Compliance with the Zoning Ordinance, Section VI, G, 8, a and b;
