The Planning Commission on September 4, . <br /> 1996 recommended denial of Planning Case #96-13, Variances (front and side yard .. <br /> setback), the recommendation was based on the following findings: <br /> 1. There are alternative locations on the site without topographic or lot configuration <br /> issues that would comply with ordinance requirements; I <br /> 2. There are no neighborhood development patterns that would suggest that the <br /> requested variance would allow the subject property to more nearly conform to I <br /> neighborhood standards; <br /> 3. Although three car garages are commonplace in some neighborhoods, the three or <br /> four garage spaces proposed for this site are not common in this neighborhood I <br /> and their is no apparent precedent indicating that every homeowner is entitled to <br /> three or four garage spaces; and <br /> 4. The conditions regarding health, safety, comfort and general welfare of the public I <br /> (applicant's rationale #3) are not grounds for a variance, but have to exist even if <br /> there are grounds for a variance. <br /> D. Updates. None. I <br /> Case #96-14. Variance - Front & Side Yard Setback I <br /> Bernard & Rhonda Brouillettc. 3320 Lake Johanna Boulevard <br /> A. Request. The applicant requests approval offront and side yard setback variance to " <br /> allow for the construction of a 24 foot by 30 foot detached garage (Exhibit C). The front <br /> yard setback is proposed to be 20 feet while 40 feet is required and the side yard is I <br /> proposed to be 5 feet while 10 feet is required. <br /> B, Background. The property currently does not have a garage. Nearly all of the garages I <br /> on the lots along this section of Lake Johanna Boulevard and along Sandeen Road to the <br /> south (about 17 homes) were constructed close to the street with only a small drive apron <br /> between the garage and street. The garage on the lot to the north is approximately 12 ft. I <br /> from the curb and the garage to the south is about 13 feet from the curb. The paving <br /> width of lake Johanna Boulevard occupies nearly all of the right-of-way with perhaps two <br /> to three feet of boulevard on each side. The 20 foot setback requested will allow cars to I <br /> park on the apron (an advantage not enjoyed by most of the properties in this area along <br /> Lake Johanna Boulevard), as well as in the garage. I <br /> The applicant proposes to construct the new garage with a five foot setback from the <br /> south property line and 18 feet from the north property line. A 10 foot side yard setback 1 <br /> is required, so a five foot variance is requested. The previous garage on this site was <br /> placed on fill which still remains as a level area in the SW comer of the site, The <br /> Planning Commission and the Staff would conclude that the rationale for the front yard I <br /> variance does not apply to the side yard variance and that the standard 10 foot setback <br /> should be used. The side yard setbacks will then be 10 feet on the south and 13 feet on .. <br /> the north. <br /> I <br /> ---- --- --- <br />
