THIS SUMMARY IS DEVELOPED ACCORDING TO THE LANGUAGE IN <br /> PLACE IN ARDEN HILLS CONCERNING THE PLANNING COMMISISONS RESPON- <br /> I SlBILITIES WHEN CONSIDERING VARIANCES AND SPECIAL USE PERMIT <br /> CHANGES, ETC. <br /> . . Impair general welfare (see Items 3- 5) <br /> I . Changes requested are contrary to the intent, purpose, and explicit wording of the <br /> Comprehensive Plan and Zoning Ordinances (see Items 1 through 5) <br /> I . Variances shall not allow a use in a district that is not otherwise allowed <br /> (see Items 1 through 4) as well as definition of "shall" as a mandatory term <br /> I . The Council may impose conditions in the granting of variances to insure <br /> compliance and protect adjacent properties [that was done when the special <br /> .. use permit was originally issued and, further, when the Zoning Ordinances <br /> were agreed to in 1993]-(see Item 1) <br /> . Previous cases provision-there are no precedents for these requests <br /> I (see Item 1) <br /> I . The variance should not be greater than necessary to accomplish the <br /> landowner's objective-the objective is convenience-based. There are <br /> alternative solutions which should be pursued (see Item 2) <br /> . . Alternative locations, development concepts, or space requirements exist <br /> (see recommendations identified Item 2) <br /> I . The variance requested is not consistent with the surrounding development <br /> I (see Item I as well as comment about state statutes regarding variances) <br /> . Conforming to the literal provisions would result in undue hardship (see <br /> I Item 2 and disparity issue identified in Item 5) <br /> The variance would improve an existing nonconforming condition (on the <br /> . <br /> I contrary, the granting of a variance would create a nonconforming condition- <br /> see Items 1, 3, and 5) <br /> f' .
