Only one "food court" or "drive, in business court" or building containing fast food <br /> restaurants or drive-in businesses will be allowed in addition to one free-standing fast <br /> food restaurant; <br /> I 4. The architecture and the site, grading, circulation, landscaping, screening and signage <br /> plans shall unify the appearance and function of the complex or building; and <br /> 5. A "fast food court" or "drive-in business court" may consist of one or more buildings on <br /> I one or more parcels if the intent of providing a unifIed appearance and function is not <br /> compromised. <br /> I Mr. Ringwald advised the Planning Commission found this is a fast food use within 1,320 feet of <br /> the Burger King, the use did not warrant the waiver, would cause unnecessary traffic impact to <br /> I adjacent streets, and does not comply with the Lexington Business Area Plan. <br /> Councilmember Hicks inquired regarding the area which is encompassed by the PUD. Mr. <br /> I Ringwald advised it encompasses the entire parcel owned by St. Paul Properties, <br /> Mayor Probst noted this application is being presented for consideration of approval of the PUD <br /> I Master Plan. He stated he has spoken with the applicant and did not have the impression that <br /> was the request under consideration tonight. Mr. Ringwald advised the application was for <br /> approval of the PUD Master Plan which is the action considered by the Planning Commission. <br /> Ie Doug Kennedy, Franchise Associates, Inc., explained that after the Planning Commission <br /> meeting, they met with staff to determine what would satisfy the City's concern with regard to <br /> I traftic issues. In response to their question, Mr. Ringwald recommended they approach the <br /> Council to ask if the Arby's/Sbarro use is acceptable. If not, the request will be dropped but if it <br /> is acceptable, they will approach Shannon Square to determine how to resolve traffic concerns. <br /> I Mayor Probst asked if timing issues are involved with regard to the consideration of this <br /> I application. Mr. Ringwald stated the City has 120 days to review land use requests and currently <br /> is on the second 60 day period. The Council must make a determination by Thursday, December <br /> 19,1996. He noted if the City denies this request, that rationale for that determination must be <br /> I provided to the applicant at the meeting. <br /> Mayor Probst expressed reservations with the proposal as presented and under consideration <br /> I tonight. He reviewed the history and logic for determining this B-3 zoning district and the need <br /> to assure proper development of this area so traftic issues are appropriately addressed. Mayor <br /> Probst stated he is interested in knowing whether the applicant is willing to work with the City to <br /> . determine the "larger picture" and how to address this site as a whole. <br /> Councilmember Malone stated he shares the Mayor's concern about the development of this area <br /> I off Lexington Avenue with limited additional curb cuts. He stated he understands this type of <br /> food establishmcnt is needed but the need also exists to assure orderly development. <br /> tt <br /> I <br />
