<br />Minutes of the Arden Hills Regular Council Meeting, May 30, 1989 <br />, Page 4 <br /> <br />OAK AVE. (Cont'd) Charles Roach, 1628 Oak Ave., spoke in opposition to the <br />assessment. He did not feel the improvement benefits all <br />residents in the area. Roach advised his property has a driveway easement; his <br />deed does not show an easement for storm water drainage. <br /> <br />. <br /> <br />Peters explained a driveway and drainage easement would have to be obtained to <br />complete the storm sewer project and maintain the area in the future. He advised <br />there was no previous assessment for storm sewer in this area. <br /> <br />Brian Heicht, 1620 Oak Ave., stated he purchased his property one year ago and <br />discussed the erosion problem with Peters at that time; he was under the <br />impression that Albjerg would be responsible for correcting the problem or the <br />City would pay for the improvement and feels he was misinformed. Heicht stated <br />the erosion is not only limited to Albjerg's driveway but has caused gullies <br />throughout his property; he questioned if fill would be placed in the gullies to <br />correct the problem. <br /> <br />Peters eXplained he did not recall misleading Heicht regarding the responsibility <br />for correcting the drainage problem and that one year ago no Council plan for <br />assessment had been determined; he stated the gullies could be replaced with any <br />excess materials from the project. <br /> <br />Brad Smegal, 1644 Oak Ave., asked when the residence at 1680 was established and <br />if any thought,was given to drainage at that time. He stated he also has a <br />drainage problem. <br /> <br />. <br /> <br />The Engineer stated the house was in place at that location prior to the road <br />being constructed and the driveway was in place before the bituminous surface was <br />placed on the road. <br /> <br />Bill Miller, 1584 Oak Ave., stated he previously lived at 1587 Oak Ave., which is <br />low land, and experienced standing water in his backyard from drainage waters. He <br />inquired at the time to find a possible solution to the problem and was advised a <br />sewer should be constructed through his property; he assumed at that time there <br />would not be a general assessment in the neighborhood for such a project. Miller <br />stated there should have been consideration given at the time the roadway was <br />constructed to the elevations and drainage; any assessments should take into <br />consideration other drainage problems in the area. <br /> <br />Bruce Meyers, 1608 Oak Ave., was opposed to the assessment and agreed with all <br />comments from other residents. <br /> <br />Michael Daub asked for clarification as to the extent of cost to the Albjergs for <br />the project beyond the $4,000.00 for their driveway repair; if the costs will be <br />beyond the $4,000.00 figure it should be based upon the extent to which there is <br />runoff from their property and should be considered as an assessment. <br /> <br />Leroy Fingerson, 1612 Oak Ave., spoke in opposition to the assessment. He stated <br />it appears to be a City problem due to the street construction. <br /> <br />Don Erickson, 1611 Oak Ave., spoke in opposition to the assessment. <br /> <br />. <br /> <br />Robert Ashbach, former Mayor of Arden Hills, appeared before the Council to <br />provide some historical information relative to the construction of Oak Avenue. <br />He stated the homeowner at 1680 Oak Avenue had requested a permit for access to <br />the property and Council had questioned what the resident proposed to do with the <br />runoff. The homeowner stated he would surface the driveway and the drainage would <br />run into the County park; Ashbach explained the homeowner had agreed to take the <br />responsibility for the drainage. <br />
