(Cont'd) <br /> <br />Attorney Filla questioned if Oak Avenue was constructed <br />at the time of the request. <br /> <br />Ashbach advised the street was constructed at that time. <br /> <br />Mayor Sather asked if there were any further comments from the audience. There <br />was no response and the public hearing was closed at 8:15 p.m. <br /> <br />Councilmember Mahowald questioned the potential for other drainage problems and <br />if the Engineer is aware of any other drainage problems at this time. <br /> <br />Peters advised that during the time he has been working on this matter he has <br />discussed a drainage problem with one property owner adjacent to the railroad <br />tracks. The Public Works Supervisor advised he was aware of the problem the <br />engineer identified. <br /> <br />Mr. Heicht, 1620 Oak Avenue, advised he resides on the south side of 1680 Oak <br />Avenue and the water passes through his property and created a deep rut in the <br />ground approximately 3 to 4 ft. deep. He is concerned that the ruts will not be <br />filled. <br /> <br />Mr. Vanderheiden, 1655 Oak Avenue, advised he has a pool of water in his yard in <br />the spring; he identified another resident in the area who experiences the same <br />problem and pumps the water out of her yard every year. Another neighbor in the <br />area reported a resident had constructed a private storm sewer to eliminate their <br />drainage problem. <br /> <br />The previous owner of the property at 1587 Oak Avenue stated he was contacted <br />relative to installation of the private sewer system, however, the cost was too <br />high and he opted not to be involved. <br /> <br />Councilmember Hansen questioned if there is currently a storm sewer in this area <br />and if the property owners had paid an assessment for a storm sewer. <br /> <br />Engineer Peters advised there is no storm sewer currently in the area and <br />therefore no assessment would have been paid. <br /> <br />Hansen noted it has been indicated the road may have been improperly constructed. <br />She questioned if rip-rap would be a feasible method for eliminating the problem. <br /> <br />Peters stated the driveway is not wide enough to accommodate a rip-rap spillway <br />down the middle; it would not be the most feasible means of correcting the <br />problem. <br /> <br />Councilmember Hansen stated the problem should be resolved and she did not favor <br />assessing the residents in the area. <br /> <br />Councilmernber Malone commented there is a need to proceed with the improvement <br />and it appears that the costs may have to be shared between the taxpayers in the <br />area and generally throughout the city. He noted other taxpayers have paid a <br />storm sewer assessment for their respective area. Malone suggested the resident <br />at 1680 Oak Avenue be required to repair the driveway to city specifications or <br />negotiate an agreement whereby the city repairs the driveway in conjunction with <br />the improvement and the resident reimburses the city for the costs. <br />
