(612) 228-1753 <br /> June 3, 1992 <br /> Catherine Iago <br /> City Administrator ~ <br /> City of Arden Hi].is <br /> 1450 West Highway 96 <br /> Arden Hills, MN 55112 <br /> RE: Development Moratorium <br /> Interim Ordinance <br /> Our File No.: 10450/920001 <br /> Cathy: <br /> It is my understanding that the City is currently undertaking <br /> a comprehensive review of its zoning regulations and is concerned <br /> about its obligation to review development applications which will <br /> be impacted by pending changes to the City's official controls. <br /> The City has the authority to halt development until it completes <br /> its review af the zoning regulations. <br /> In order to implement a development moratorium, it would be <br /> necessary for the City to adopt an Ordinance which specifies that <br /> the City is conducting studies and/or is scheduling public hearings <br /> to consider amendments to its comprehensive plan or official <br /> controls and that a development moratorium is necessary in order to <br /> protect the planning process and the health, safety and welfare of <br /> the citizens of the City of Arden Hills. The Ordinance may halt <br /> development for one year and may be extended for up to eighteen <br /> additional months. <br /> The Ordinance would become effective following the date of <br /> publication. However, the Ordinance cannot delay subdivisions <br /> which preliminary approval has been given prior to the effective <br /> date of the interi.m Ordinance. <br /> The Ordinance should be considered at a public hearing before <br /> the City's Planning Commission. The Public Hearing should be <br /> preceded by ten days published notice. The Ordinance must be <br /> approved by three affirmative votes of the City Council.
