Zoning - Uses do not .fit predefined categories (determination by Planning Commission <br /> . required); HHW site operation would require an exception from the Staging Area <br /> requirement for the CC district. <br /> The uses proposed in the amendment to the Special Use Permit (SUP) includc a uscd oil <br /> collection building which would be open 24 hours a day for 365 days a ycar. Also included <br /> in the proposed SUP Amcndmcnt is a seasonal Household Hazardous Waste (HHW) site <br /> which would likely operate during regular business hours on Fridays and Saturdays for one <br /> or more months. Neither of the uses fits exactly into any predetermined use on the Land Usc <br /> Chart. However, hoth uses sccm compatible with thc adjaccnt "yard" area of thc Ramsey <br /> County/Partners Public Works Facility. At the December 2004 meeting, several questions <br /> werc raised about the 24 hour operation of the used oil facility. In the updated narrative <br /> provided by the applicant, thc applicant indicatcs that there is a camera in place at the filling <br /> station just west of the proposed used oil collection facility. Thc applicant also indicates that <br /> an additional camera could be added if it were determined to be necessary. The applicant <br /> also states the current facility has been operated on a 24 hour basis and they have not had <br /> many problems. The narrative also states that if someone attempted to use the facility and it <br /> were found to be closed, they pcrson may just lcave the used oil outside of the gate or <br /> dispose of the used oil improperly. The applicant indicatcs a 24 hour facility should <br /> eliminate that scenario. <br /> 2. Aesthetics - Does Not Meet CC District Exterior Materials Requirement. <br /> . The proposal calls for an area of impervious surfacc and one 200 square foot building to <br /> contain the used oil collection area. The proposed building would be of metal construction <br /> (walls and roof) which is currently not permitted under the Civic Center District <br /> requircments. While thc interest of the Civic Center District is to crcate an area of attractive <br /> public facilities, with the exception of the "face" ofthe complex facing Highway 96, the <br /> remainder of the building and accessory buildings havc been constructed of pre-cast concretc <br /> or other materials not specifically permitted in the CC District. The proposed used oil <br /> collection building should not be visible from Highway 96, only from the internal portion of <br /> the site or from the rcar. The applicant has proposed that a non mortar brick wainscoting to <br /> cover thc base of the wall would bc included soften the appearance of thc building. In <br /> addition the applicant would includc a shingle roof to also help with the appearance of the <br /> building if the Planning Commission required it. The attachments show pictures of other <br /> buildings which have similar construction materials to what is being proposed. <br /> 3. Lot Coverage - Code Requirement Met <br /> The CC: Civic Center District requires that no more than 40% of the lot bc covered by <br /> structure.
