At the December I, 2004 meeting the Planning Commission discussed massage <br /> regulations and whether they should be revised. The discussion arose because resident <br /> Karin Muska had inquired about having Therapeutic Massage as a home occupation. The <br /> general direction of the Planning Commission was that Therapeutic Massage was <br /> something that should be allowed in Arden Hills and should be considered as a suitable <br /> Home Occupation. Furthermore, the Planning Commission asked staff to check with <br /> surrounding communities to see how they handled regulating Therapeutic Massage. <br /> Home Occupation vs. Massage. Rap. and Sauna Parlor regulations <br /> In regard to Ms. Muska's request, it would have been classified as a Class II Home <br /> Occupation. The Class II Home Occupation requires a Special Use Permit to be <br /> approved by the Planning Commission and City Council before the applicant can begin <br /> operating the home occupation. However, the language listed under Section 330.03 of <br /> the City Code prohibits the operation of a massage business within 500 feet of any <br /> residential zoning district, a church, a nursery, a school, or any establishment frequented <br /> by juveniles. Therefore the current language in Section 330.03 precludes the operation of <br /> a Massage Parlor as a home occupation. <br /> Comparison of Other Cities' Therapeutic Massage Regulations in General <br /> Of the dozen or so cities that staff contacted about massage regulations, six communities <br /> responded. In regard to Therapeutic Massage businesses as a use, four ofthe six cities <br /> had special language to regulate the use; the remaining two simply include the use as a <br />. permitted use in specific commercia] zoning districts. The language from the other four <br /> communities has been attached for your review. As you will see, most of these <br /> communities require the business to be licensed and comply with life safety codes. <br /> - <br />
