Utilize the existing language from Section 330.03 and amend it to include <br /> updated definitions and language with the aforementioned standards, and <br /> also provide exclusions for Therapeutic Massage where approved through <br /> a Special Use Permit as a home occupation? <br /> 3. Create all exception for Therapeutic Massage as a home occupation under <br /> Section 330.03, Subd. 8, A, 3 to read: <br /> (a) "Except where Therapeutic Massage has been permitted as a home <br /> occupation through the issuance of a Special Use Permit. Such <br /> massage uses shall be allowed in residential zoning districts and shall <br /> at all times comply with the conditions as established through the <br /> Special Use Permit and the City's home occupation regulations. " <br /> Recommendation <br /> Staffs recommendation would be to delete the existing Section 330.03 and replace it <br /> with language from either the Shoreview or Falcon Heights Therapeutic Massage <br /> regulations. In particular the Shoreview language could be amended to add a new section <br /> following "Massage Therapy Establishment Restrictions" which would amend the <br /> restrictions for Massage Therapy Home Occupations. The revised restrictions could read <br /> as follows: <br />. (A) The premises shall comply with applicable Zoning, Fire, Health and <br /> Building Codes. <br /> (B) The premises and equipment shall be clean, sanitary and well maintained. <br /> (C) The holding of a license hereunder does not negate the requirement to <br /> hold other licenses or permits which may be applicable. <br /> (D) No f!amblinf! shall be vermitted on the licensed vremises while customers <br /> of the home occuvation are on the vremises. <br /> (E) No alcoholic beveraf!es shall be allowed on or vermitted to be brouf!ht <br /> onto the licensed vremises bv customers of the home occuvation. Nor <br /> shall alcoholic beveraf!es be offered to or vrovided to the customers of the <br /> home occuvation. <br /> (F) No person who is visibly under the influence of alcoholic beverages or <br /> drugs shall be allowed on the licensed premises. <br /> (G) No person shall be permitted to engage in disorderly conduct on the <br /> licensed premises and the licensee shall obey any reasonable order of the <br /> City's law enforcement agency to terminate or prevent such disorderly <br /> conduct. <br /> (H) Licensees shall comply with City, County, State or Federal laws, rules and <br /> regulations which are applicable to the licensed premises. <br /> (1) The licensed [)remises shall be closed between the hours of 10:00 v.m. and <br /> 8:00 a.m. on weekdavs and shall be closed between the hours of6:00 v.m. <br /> and 10:00 a.m. on weekends. <br /> (J) Customer avvointments shall be scheduled so that there shall not be a <br />. need for a waitinf! room. If a waitinf! room is determined to be necessary <br /> it shall be sevarate from anv area wherein massaf!e theravv is verformed. <br /> - ---- <br />
