Zoning Ordinance? <br /> The stated Purpose and Intent of the City's Zoning Ordinance includes thirteen purposes, <br /> of those the following statements appear to be applicable: <br /> This ordinance is enacted for the following purposes: <br /> . To promote the general public health, safety, comfort and general welfare of the <br /> inhabitants of the City of Arden Hills, Minnesota. (l,B,I) <br /> . To promote the proper use ofland and structures. (I,B,6) <br /> . To fix reasonable standards to which buildings, structures and land shall conform <br /> for the benefit of all (l,B,7) <br /> The stated purpose ofthe R-2: Single and Two Family Residential District as stated in <br /> Section 5, D, 2 is: <br /> . To establish areas for the development of single and two family housing at a <br /> maximum density of approximately 5 units per net acre. <br /> . To reserve development areas for single and two family housing. <br /> . To restrict encroachment of incompatible uses. <br /> . To maintain density limitations. <br /> . To take advantage of municipal utilities. <br /> . To preserve open space. <br /> e (YES) The applicant's proposal for the subject property complies with the intent of the <br /> R-2 District and the Zoning Ordinance by maintaining density limitations and allowing <br /> the applicant to maintain the property for a single-family residential structure. Many of <br /> the structures surround the applicant's property are as close or closer to the front <br /> property line and the construction of the new house would create larger front and side- <br /> yard corner setbacks than the existing house while allowing the applicant to improve the <br /> property with construction of the new house. The variance would allow for the <br /> construction of a new house on this property while improving the setback situation over <br /> the existing non-conforming building. <br /> 3. Could the property in question be put to a reasouable use without the granting of <br /> the variance? <br /> (NO) The additional setbacks due to the corner location create a very small building <br /> envelope on what was already a small lot. A reasonable house and garage structure <br /> could not be built and meet both the front and rear setbacks without a variance.
