Conformity with the rest of the Subdivision Ordinance: The proposed division or <br /> consolidation shall conform to all requirements of the subdivision Ordinance unless <br /> given an exemption by the Planning Commission and City Council. <br /> 5. Fees: All filing fees must be paid. <br /> Staff has reviewcd these criteria and oilers the following findings of fact: <br /> I. The submitted survey was prepared by a registered land survcyor and meets <br /> pertinent City requirements. <br /> 2. As noted above, the proposed lots meet the area and dimensional rcquircments of <br /> the R-l Zone. Howcver, an existing dwclling cncroaches six feet on the proposed <br /> new property linc. The applicant has submitted a variance application to allow this <br /> encroachmcnt to remain. <br /> 3. The proposed subdivision is un likely to have any negative affcct on the public <br /> welfare with the appropriate conditions. While thc other properties on the same <br /> block as the subjcct property tend to be larger, the subject property is comparable to <br /> other lots within this subdivision. The average size lot in this subdivision is .43 <br /> acres, and the other lots in the subdivision range from .26 acres to .86 acres. The <br /> proposed western property would be approximately .4 acres, and the proposed <br /> eastem property would be approximately .41 acres. The properties immcdiately . <br /> across the strect from the subject property have similar lot widths as the subject <br /> property. Finally, if a new dwelling is constmcted on thc eastcrly lot, that will <br /> contribute to the local tax basc without significantly taxing the existing <br /> infrastructure. <br /> 4. The applicant has met all other applicable requirements of thc Subdivision <br /> Ordinance. The proposed lots have access to a public road, have adequate buildablc <br /> areas, and meet the requirements of the R-l Zone. <br /> 5. All rcquired application fees have bccn paid. This subdivision docs rcsult in the <br /> creation of two ncw residential lot. Under Section 1130.08 ofthc Subdivision <br /> Ordinance, thc park dedication fee would apply to this case. The Recreation and <br /> Conservation portion (Subd. 2) requires that all subdivisions dedicate a portion of <br /> their land for recreation and conservation purposes or, as deemed comparable value <br /> by the City Council, pay a park dedication fee in place of a land dedication. <br /> Although the applicant is not proposing a land dedication, a subdivision rcsulting in <br /> one new residcntial lot would rcquire a land dedication of six percent, which would <br /> be .049 acres or about 2, I 43 square feet.
