<br /> 1. The submitted survcy was prepared by a registered land surveyor and meets City <br /> requirements. . <br /> L As noted above, the proposed lots meet all requirements ofthc undcrlying R-2 <br /> Zone. <br /> 3. The proposed subdivision and consolidation is unlikely to have any negative affcct <br /> on the public welfare. The previously plattcd lots wcre less than 5,000 square feet, <br /> which is below the 11,000 squarc foot minimum lot size. The consolidation will <br /> rcmove the potential that the originally platted 5,000 square foot lots would be <br /> developed individually. The proposed lots are comparable to and compatible with <br /> neighboring lots within the subdivision. Finally, if a dwelling is constructed on thc <br /> lot, it would contribute to thc local tax base without significantly taxing the existing <br /> infrastructure since the lot already has access to City infrastructurc. <br /> 4. The applicant has mct all other applicable requirements of thc Subdivision <br /> Ordinance. Thc applicant has providcd the necessary easements and access for the <br /> property. There is sufficient buildable space on the proposed lot for constmction <br /> without a variance. <br /> 5. All required application fees have bccn paid. This subdivision does result in the <br /> creation of onc new residential lot. Under Section 1130.08 of the Subdivision <br /> Ordinancc, the park dedication fee would apply to this case. The Rccrcation and <br /> Conscrvation portion (Subd. 2) requires that all subdivisions dcdicate a portion of <br /> thcir land for recreation and conservation purposes or, as dccmed comparable value <br /> by the City Council, pay a park dedication fcc in place of a land dedication. <br /> Although the applicant is not proposing a land dedication, a subdivision resulting in . <br /> onc new residential lot would require a land dcdication of six percent, which would <br /> be .09 acres or 4,025 square feet. Given the small size of the potential land <br /> dedication and the availability of other nearby park facilities, a park dedication fee <br /> may be morc appropriate thcn a land dedication. In lieu of thc land dedication, the <br /> City Council may requirc the applicant to pay, as an equivalcnt contribution, an <br /> amount in cash equal to the percentage ofthe land rcquired to be dedicated, <br /> multiplied by the fair market value of the property at the time of the final approval <br /> of the subdivision. <br /> Should a fee bc accepted in lieu of a land dedication, the park dedication fce would <br /> be six perccnt of the land value of the propel1y at the timc of final approval of the <br /> subdivision. The 2006 market value according to Ramscy County records is <br /> $606,500. This value would result in a park dedication fce of$36,390.
