In Plmming Case #06-004, staff recommends approval of the Minor Subdivision and <br /> Consolidation after making a finding that thc proposed subdivision meets City standards and wilI <br /> not have an adverse impact on thc sUITOlmding propcrties or on the community as a whole; <br /> subject to thc following condition: <br /> 1. The applicant shall file the minor subdivision with the Ramsey County recorder and <br /> shall provide the City with a recorded copy within thrcc months of the final approval <br /> date. <br /> 2. The applicant shall pay a park dedication fcc before filing the subdivision and <br /> consolidation with Ramsey County. The dedication fee shall be dctcrmined by thc <br /> City Council. <br /> 3. The applicant shall sign a Declaration of Restrictive Covenants that is filed with the <br /> deed on thc propcrty. Thc City Attomcy shall rcvicw the covenants before the <br /> subdivision is filed with Ramsey County. The Declaration of Restrictive Covenants <br /> shalI include the following: <br /> a. The propcrty shall rcmain subject to thc conditions in Planning Case #70-36 <br /> and 05-03. <br /> b. Lots 1,2, and 3 of the Minor Subdivision and Consolidation in Planning Case <br /> #06-004 shall not be further subdivided or reverted back to their originally <br /> platted lots as required by Condition 3 of Planning Case #05-03. <br /> c. The applicant agrees that thc conditions of this Covenant and previous <br /> conditions placcd on thc property from Planning Case #70-36 and 05-03 <br /> . cannot bc changcd or removed without the written consent ofthc Ardcn Hills <br /> City Council. <br /> 4. Any extension of City services for the ncw lot shall be subject to approval by the City <br /> Engineer and all associated costs shall be thc rcsponsibility of thc applicant. <br /> 5. The applicant shall comply with applicable provisions of the City Code and related <br /> ordinances. <br /> Resident Comment <br /> Staff has not rcceived any letters, emails, or telephone calls from property owners or occupants <br /> in regard to this planning case. <br /> Options <br /> 1.
