The appropriate building permits for the air handlers shall be obtained within one <br /> . ycar and construction shall be completed within two years or the permit shall expire. <br /> The Council may extend the expiration dates of this approval upon written application <br /> of the applicant. <br /> 4, The fencing shall be installed as proposed immediately after installation of the air <br /> handling units. <br /> 5. Any trees that have died since the initial development of the site must be replaced per <br /> landscape plans approved by staff no later than June 1, 2006. <br /> 6. The applicant shall be required to submit a noise mitigation plan in the future if the <br /> City receives complaints regarding noise generation by the unit and said complaints <br /> are validated by City Staff <br /> 7. Should the off-site parking that Celestica's employees are currently using become <br /> available or inadequate, Celestica shall reapply for a special use permit amendment to <br /> expand parking similar in nature to Planning Case 01-12a and 01-12b. These <br /> applications shall require City review under the standard review process for a special <br /> use permit amendment. <br /> 8. The air handling units shall be installed in accordance with the plans submitted. <br /> Minor modifications may be made to the plans subject to approval by the City <br /> Planner. Significant changes to the plans require review and approval through the <br /> Site Plan Review Process. <br /> Commissioner Thompson inquired about the parking. Charles Patterson, representative <br /> of Celestica explained the parking requests and requirements. <br /> . Chair Sand opened the public hearing at 8:28 p.m. <br /> Chair Sand invited anyone for or against the request to come forward and make <br /> comment. <br /> There were no public comments made. <br /> Chair Sand closed the public hearing at 8:29 p.m. <br /> Commissioner McClung asked if the MPCA had been contacted concerning the noise <br /> regulations. Mr. Lehnhoffresponded staff was not able to get any confirmation from the <br /> MPCA in time for this meeting. <br /> Commissioner McClung stated he was concerned about the parking and insufficient <br /> parking. He stated they also had to consider the visual alld land use capability <br /> considering this was a gateway to the City. He noted the Chesapeake property was still <br /> not developed and he was concerned there would be improper screening to the adjoining <br /> properti es. <br /> Commissioner Modesette asked if the applicant had looked at locating the equipment on <br /> the roof. Mr. Patterson, applicant, rcsponded given the size and weight of the equipment, <br /> . it would require major structural modifications to the building and therefore they <br /> determined the best location would be on the ground. He noted the compressors would <br /> also create mechanical vibration which would generate noise and vibration within the <br /> building, which was an issue. <br /> 9 <br /> -- ---------..----- <br />
