<br /> Findings: . <br /> Staff has reviewed these criteria and offers the following findings of fact: <br /> 1. The submitted survey was prepared by a registered land surveyor and meets <br /> pertinent City requirements. <br /> 2. Parcel B, the interior lot, does not meet the minimum 85 foot lot width requirement. <br /> The proposed lots meet all other area requirements of the R-2 Zone. <br /> 3. While there are two lots immediately north of the subject with substandard lot <br /> widths, approximately 50 feet each, all other properties on Thom Drive in this <br /> neighborhood meet or exceed the minimum lot width. Although the subdivision <br /> may not be injurious to adjacent properties, Parcel B does fail to meet the full <br /> minimum requirements of the R-2 Zone. <br /> 4. The applicant has met all other applicable requirements of the Subdivision <br /> Ordinance. The proposed lots have access to a public road, have adequate buildable <br /> areas, and meet the requirements of the R-2 Zone. <br /> 5. All required application fees have been paid. This subdivision does result in the <br /> creation of one new residential lot. Under Section 1130.08 of the Subdivision <br /> Ordinance, the park dedication fee would apply to this case. The Recreation and <br /> Conservation portion (Subd. 2) requires that all subdivisions dedicate a portion of <br /> their land for recreation and conservation purposes or, as deemed comparable value <br /> by the City Council, pay a park dedication fee in place of a land dedication. <br /> A subdivision resulting in one new residential lot would require a land dedication of <br /> six percent. Given the small size of the potential land dedication and the <br /> availability of other nearby park facilities, a park dedication fee may be more . <br /> appropriate then a land dedication. In lieu of the land dedication, the City Council <br /> may require the applicant to pay, as an equivalent contribution, an amount in cash <br /> equal to the percentage of the land required to be dedicated, multiplied by the fair <br /> market value of the property at the time of the final approval of the subdivision. <br /> Should a fee be accepted in lieu of a land dedication, the park dedication fee would <br /> be six percent of the land value ofthe property at the time of final approval ofthe <br /> subdivision. The 2006 market value according to Ramsey County records is <br /> $105,500. This value would result in a park dedication fee of$6,330. <br /> 3. Granting a Variance for a Subdivision - Findings Required <br /> Ordinance: <br /> Section 1150.01 of the Subdivision Ordinance allows the City to grant a variance for a <br /> subdivision if the following conditions exist: <br /> 1.
