<br /> ARDEN HILLS PLANNING COMMISSION - FEBRUARY 1, 2006 4 <br /> property to remain, which would encroach on the side yard setback of the new property <br /> line between the two proposed lots. Staff recommended approval of the minor . <br /> subdivision subject to the following conditions: <br /> 1. The applicant shall file the minor subdivision with the Ramsey County Recorder and <br /> shall provide the City with a recorded copy within sixty days of the final approval <br /> date. <br /> 2. The applicant shall file the 2I-foot drainage and utility easement with the Ramsey <br /> County and shall provide the City with a recorded copy within sixty days of the final <br /> approval date. The restrictive easement may be incorporated with the deed for the <br /> land or submittcd as a separate recordable document. <br /> 3. The applicant shall pay a park dedication fee of six percent of the market value of the <br /> land at the time of the final approval of the subdivision. The portion of the existing <br /> structure that is designated for removal on the submitted survey shall be removed <br /> before any new building permits are issued for any structures on either lot except for <br /> any permits needed to remove the required portion of the existing dwelling. <br /> 4. The structure on the western lot shall be moved to a location that meets all required <br /> setbacks of the R-I zone, including the front lot setback of 40 feet from the right-of- <br /> way, Any additions to the existing dwelling on the western lot shall meet all setback <br /> requirements. <br /> 5. The structure on the western lot shall be moved into a location that meets all required <br /> setbacks before any building permits are issued for any new structures on either lot <br /> except for any pennits needed to move the structure into a conforming location. Any <br /> new structures on the western lot shall not encroach any closer than 21 feet to the . <br /> western lot line to preserve a total of 25 feet of the side lot setback as required in the <br /> R-l Zone. <br /> 6. Any extension of City services for the new lot shall be subject to approval by the City <br /> Engineer and all associated costs shall be the responsibility of the applicant. The six <br /> pine trees, two oak trees, and one elm tree between the western edge of the existing <br /> structure alld the western lot line shall not be removed without approval of the City <br /> Council (The trees and their location are identified on the Site Development Plan for <br /> 1401 Skiles Lane). If the trees are determined by the City to be dead or dying, the <br /> trees may be removed and shall be replaced in accordance with the Design <br /> Requirements of the Lalldscape Plan provisions of Appendix A, Procedural Manual, <br /> of the City of Arden Hills Zoning Ordinance. <br /> 7. The applicant shall comply with applicant provisions of the City Code and related <br /> ordinances. The applicant shall pay a park dedication fee before filing the <br /> subdivision with Ramsey County. The dedication fee shall be determined by the City <br /> Council. <br /> 8. Any extension of City services for the new lot shall be subject to approval by the City <br /> Engineer and all associated costs shall be the responsibility of the applicant. <br /> 9. The applicant shall comply with applicable provisions of the City Code and related <br /> ordinances. <br /> Commissioner Larson asked for elarification on the deed rcstriction area, Mr. Lehnhoff <br /> stated the applicant was proposing a drainage and utility easement, which was meant to . <br /> keep open space between the properties and the easement would be recorded on the deed <br /> to ensure it was continued into the future. <br /> 4 <br />
