Thc Staff mct with reprcscntativcs (Ray Duran, Chief Maintenance of Way Officcr and Waync <br /> Hall, Dircctor ofOpcrations) of the Minnesota Commercial Railroad on Tucsday, October 14, <br /> 1997 on the site ofthc transload operation in thc GBD. The Staff went over the survcy <br />I information with the reprcsentativcs of the Minnesota Commcrcial Railroad \vhich showed the <br /> cncroachmcnt ofthc transload opcration onto privatc property. Thc Staff discusscd its dcsirc to <br /> relocate this operation to a placc which would be entirely within thc railroads right-of-way. The <br />I rcprcscntatives ofthc Minnesota Commercial Railroad agreed and statcd that thcy will direct <br /> their tenant to relocated the operation to the south side of the railroad tracks and to restore the <br /> propcrty on the north sidc of the tracks to there previous condition. The Staff then discussed <br />I with thcse reprcscntatives the City's desire to obtain a slope easemcnt on thc north side of the <br /> tracks for the relocated 14th Street (Gateway Boulevard). The rcpresentatives of Minnesota <br />. Commercial Railroad stated that they would not opposc such an casement and the granting of <br /> such an easement would be up to the owner of the property (MT Properties). Thc Staff has had <br /> previous discussions with MT Properties (Gordon Forbcs) regarding the slopc eascmcnt and he <br />I was in favor of it as long as thc tenant found it acceptable. Lastly, the Staff discussed the <br /> potential of open-cutting thc railroad tracks, rather than boring underneath the railroad tracks, as <br /> open-cutting is considcrably less expensive. The reprcsentatives of Minnesota Commercial <br />Ie Railroad indicated that opcn-cutting would bc acceptable, but they would nccd to revicw the <br /> timing and rcconstruction plans with the City Engineer. <br />I Tax Increment Financing <br /> Thc City Council will bc rcceiving a scparate bench handout on this itcm. <br />. Condition 27. Provision of a 12 inch watermain on Phase II. unless it can bc shown <br /> to the satisfaction of Staff that an 8 inch water Iinc will meet the <br /> requirements of the Phase II buildiol!, <br />I The Staff was informed by the applicant's consultant today that their fire consultant calculates <br /> that a ten (10) inch watermain is required. The Staff has not yet seen the information which <br />. would support this conclusion. <br /> Condition 28, Provision of a modified landscape plan enhancing the area to the <br />I north of Phases III and IV to effectively screen this area from Round <br /> Lake, <br /> Thc applicant's consultant providcd to Staff today revised drawings for enhancing the <br />. landscaping at the north sidc of Phases III and IV. The Landscapc Plan (Sheets L1.3 and L1.4) <br /> show an additional 36 evergreen planted along thc north edgc of Phases III and IV. Thc Staff is <br /> supportive of the changes, exccpt that the placcment of the easterly two groupings on Phase III <br />I and thc westcrly grouping on Phasc IV should be relocated north towards thc conscrvation <br /> cascment. Thc rationale for this relocation is that this part of the site is the high point and to <br />.- maximizc thc scrccning potential thc vcgctation should be as close to thc top of that high point so <br /> as to effectively scrcen from Round Lake. <br />I <br /> - ----- <br />
