Park dedication to bc resolved prior to issuance of Building Permit. <br />Naegele Acouisition . <br />Thc Staff received on Monday, October 13, 1997 a memorandum from thc attorneys for Morris <br />Communications (aka, Naegele/Fairway Outdoor Advertising) with thcir critique of the purchase . <br />agrccment. The City Attorney (Jerry Filla) has rcviewcd thcsc modifications. The Staff has had <br />discussions rcgarding these modifications with Fairway Outdoor Advertising (Jeff Brown) and <br />believe that the we arc close to having closurc on this item. The primary itcm which requires . <br />clarification with thc Morris Communications attorney is can thc City can start the city code <br />modification process but will not have completed it prior to the date which the dcveloper requires <br />the property in question. The Staff, City Attorney, and thc Morris Communications attorney will . <br />bc rcsolving this item on a confcrcnce call on Wcdnesday, October 15, 1997. <br />Closing Date I <br />The developer has requestcd that the closing date be moved to October 31, 1997. While this <br />makes sensc based on the largc number of outstanding items, thc requcst to start construction . <br />prior to closing does not. The City should evaluate the risks ofbcginning work or issuing bonds <br />prior to the closing date. The attorneys are looking at methods to rcduce thc risk to the City, -I <br />should thc Council support beginning construction prior to the closing date. <br /> . <br />
