<br /> . ~ ~~~ ~ <br /> ARDEN HILLS SPECIAL COUNCIL MEETING - SEPTEMBER 22 1997 7 <br /> I <br /> .- MOTION: Malone movcd and Keim seconded a motion to approvc the Final Plans and Final <br /> Plat for Welsh Dcvclopment Company, subject to the thirty-one (31) <br /> recommendations as indicated with thc following changes: #16 add "approval of <br /> development agrccmcnts prior to final plat", # 18 "approval of address by building <br /> I official" and the addition of #32, "Park dedication to bc resolvcd prior to issuance <br /> of building permit." <br /> I Mayor Probst inquired whether an amendmcnt should be addcd to address thc vacation of 14th <br /> Street. Councilmember Malone accepted the amendment. <br /> . The motion carried unanimously (4-0). <br /> . 2, Purchase and Sale Agreement, City/Welsh Development Company, LLC <br /> Mr. Fritsinger stated the City has been ncgotiating for the past two years on development of the <br /> . Gateway Business District. The dcveloper has been in the process of obtaining rights of <br /> ownership to scveral parcels of propcrty within the GBD. The subject propcrty included in the <br /> attached Purchase and Salc Agrccment includes several picces ofpropcrty, the largcst of which is <br /> I the former Kem Milling rcndcring plant, now owncd by the City. Therc is also some property <br /> that needs to be acquired from Naegelc that abuts the Phase II building, and Nacgele is in thc <br /> final stages of reviewing purchasc agrcemcnts for this property. <br /> Ie Mr. Fritsingcr stated the purchase price for the Kem Milling property is $408,640. The <br /> remaining $85,255 is to be forgiven and credited to the developer as a result of consideration for <br /> I wetland mitigation bcing undertaken by thc dcvelopcr. Thc dcveloper has indicated that hc <br /> would like to receive rcimburscmcnt for scveral costs which, if approved by the City Council, <br /> I affect the final sale pricc. Thcse items includc: <br /> Removal of Kem Milling foundation $61,405 <br /> I Removal of gas piping $ 4,060 <br /> Removal ofwatcr main piping $ 8,210 <br /> I Mr. Fritsinger stated the foundation was not removed whcn the Kem Milling site was <br /> demolished, as it was not known at that time how thc propcrty would be developcd in the future. <br /> Staff is attempting to receive a lower bid for this removal. <br /> I Mr. Fritsinger statcd thc gas piping in question was thought to have been removed by the Fedcral <br /> government, as it is related to TCAAP gas lincs and further suggested it may be appropriate for <br /> I the City to consider paying for the costs of its removal. <br /> Mr. Fritsinger statcd thc watcr main piping removal could also bc paid for by the City, <br /> I Mr. Fritsingcr reported some dcsign issucs and some wetland issucs have not yet been rcsolved, <br /> .. and no firm amounts are known at this time regarding those issues. The Naegelc propcrty, <br /> however, is expected to be acquired at the rcgular City Council mceting on September 29th. <br /> . <br />
