MEMORANDUM <br /> DATE: January 27, 1997 <br />I TO: Mayor and City Council <br />I FROM: Kevin Ringwald, Community Development Directo~ <br /> SUBJECT: Planning Cases 96-27 and 97-01 <br />I The following is a brief review of the requests and the recommendations of the Planning <br />I Commission. The minutes ofthe January 8,1997 Planning Commission meeting are also <br /> included in your packet. <br />I Case 96-27. Arden Hills Texaco/Ouizno's. 1306 County Road E. SUP amendment & <br /> Variance <br /> 1. Request <br />I The petitioner is requesting approval of an amendment to a Special Use Permit (SUP) and <br /> variance to locate a fast food operation within the Arden Hills Texaco at 1306 County <br /> Road E (Exhibit A). <br />.. 2. Backg-round <br />I The applicant wishes to locate a fast food use (Quizno's Oven Baked Sandwich Shop) in <br /> the Arden Hills Texaco. The SUP amendment would allow the applicant to construct a <br /> new doorway on the west elevation of the existing building with a four foot by eleven <br />I foot sign above that doorway. The applicant would also provide patio seating adjacent to <br /> the west side of the building. Lastly, additional signage (four foot by seven foot) would <br /> be provided on County Road E, which would replace existing service station signage. <br />I The variance would allow the establishment of a principal (multi-operation) fast food use <br /> (Quizno's) within 1,320 feet of another fast food use (McDonald's @ 1313 County Road <br /> E). <br />I 3. Planning Commission Recommendation <br /> The Planning Commission recommends denial of the SUP amendment and variance <br />I (Zoning Ordinance, Section VI, D, 1, b) in Planning Case 96-27, based on the following <br /> rationale and findings: <br />I I. The request does not adequately delineate the unique circumstances necessary to <br /> approve a variance; <br />I 2. The granting of the requested variance, without unique circumstances, would be <br />f' contrary to the intent and purpose of this section (VI, D, I, b) of the Zoning <br /> Ordinance; <br />I <br />
