I <br /> believe these variations should be allowed ONLY WHERE POSSIBLE WITH <br />I NO VARIANCE granted from the original PUD or city code. When <br /> council approved this development on 10/10/95, they repeatedly <br /> expressed concerns for buffering & reducing impact on neighboring <br />I residences, trail, open space, & roadways (Council 8inutes, <br /> 10/10/95) . Variations from that approved plan could easily increase <br /> these impacts, contrary to council's clear intent, Also it is good <br />I to remember that these impacts, these setbacks for privacy, <br /> "buffering," & "character," cut both ways-- would townhome buyers <br /> want decks built within 3 feet of the pUblic trail? Setbacks & <br />I easements exist for EVERYone's benefit. <br /> I request the following additions to staff's recommended <br /> conditions: <br />I 1. THAT NO VARIP~CE BE GRANTED & THAT ALL SETBACKS & <br /> CONSERVATION (WETLAc'JD) & OTHER EASEMENTS BE ~~INTAINED PER THE <br />Ie PLAN APPROVED BY COUNCIL ON 10/10/95. Although we are assured <br /> that most units meet setback & easement requirements, a look at <br /> the "Patio & Deck Layout" plan shows that many of the units are <br />I very close to these lines: 1 (marginal side & back), 4 (side) , <br /> 5 (side) , 6 (side & back), 7 (side & back), 8 (back) , 9 (back) , <br /> 10 (back) . To me it seems that only units 2, 3, 11 & 12 <br />I clearly have room for the "side and/or back" option. The other <br /> units could find themselves requesting a variance, before or <br /> after the fact of construction as has happened now with unit 7. <br />I 2. Given the continuing confusion concerning what is & is not <br /> permitted in this development: That a revised final FINAL plan <br /> be submitted to show all building locations, setbacks, & <br />I easements (current) ; that this final plan also show all <br /> preserved trees & new plantings for buffering of wetlands, <br /> trail, open space & roadways; that this plan indicate the <br />I allowed placements for all future decks and/or porches. I know <br /> this is not a typical request, but since there is such intense <br /> interest in & concern over this development, my neighbors & I <br />I would find it very helpful to have such a drawing-- it might <br /> answer some questions that are NOT clearly answered in the <br /> proliferation of drawings we now have, <br />I Finally, I know that the Planning Commission is an ADVISORY <br />it group & that Council makes final decisions as they see fit, <br /> regardless of your reco~"endations. Nevertheless, I ask that you do <br /> your part to assure that all applicable ordinances, codes, rules, & <br /> the approved PUD agreement concerning this development are upheld. <br />I Thank you. <br />
