The minutes of the August 6, 1997 Planning Commission meeting have been <br /> provided under separate cover. <br />I Case #97-15. Variances - Fence. Michael Welsh, 1509 Colleen Avenue <br /> A. Request. The applicant is requesting approval of variances to allow for the continuing <br />I existence of a fence (Exhibit A). Specifically, the applicant requires variances for a fence <br /> which: exceeds the height requirement in the front yard (Zoning Ordinance, Section VI, E, <br /> 4, b); is not 30 percent open for air flow (Zoning Ordinance, Section VI, E, 4, c); and does <br />Ie not have its finished side out (Zoning Ordinance, Section VI, E, 4, f). <br /> B. Background, The applicant on April 8, 1986 applied for a building permit to allow for the <br />I construction of a deck to the side and rear of their house at 1509 Colleen A venue. The <br /> building permit for the deck was granted on April 9, 1986 (# 3266). The site plan included <br /> with the building permit request shows a "future fence". The fence which was constructed <br />I never received a building permit from the City. Therefore, the Staff was not provided the <br /> opportunity to discuss the requirements for fences with the applicant prior to the construction <br /> of the fence. At the time the fence was constructed the applicable portions of the City Code <br />I had been enacted by the City Council. <br /> In April of 1996, the City received a complaint regarding a fence located at 1509 Colleen <br />I A venue. The complaint stated that the fence was not 30 percent open for air flow and that <br /> the finished side of the fence was not facing out, as required by the City Code, Sections VI, <br />I E, 4, c and f. Staff investigated the complaint and confirmed that the fence was in violation <br /> of City Code, Sections VI, E, 4, c and f. <br />I On April 19, 1996, the City provided Mr. Welsh with written notification that his fence was <br /> not in compliance with the requirements of the City Code. In that letter, Mr. Welsh was <br /> given 60 days to modify the fence. Generally, the modifications that could be made to the <br />I fence to make it conforming with the City Code are that every other board on the fence <br /> would have to be removed from the inside of the fence and placed on the outside of the <br />~ fence. On June 12, 1996, the City received an appeal to the administrative order to modify <br /> the fence at 1509 Colleen Avenue. <br />I <br />-------- ------ <br />
