<br /> I <br /> :.r 463.26 of Minnesota Statutes (the "Hazardous Building Statutc"). These arc Sections 6-16 and <br /> 6-18 of the Code. (It should be noted that Section 6-18 refers to Uniform Code for the <br /> Abatement of Dangerous Buildings (the "UCADB"). Section 6-16 refers to the State's Uniform <br /> Building Code (the "UBC"). While the UBC, in its original version, allows abatement of <br /> hazardous buildings pursuant to the UCADB, it was amended by the Commissioner of <br /> I Administration to require that hazardous buildings be abated in accordance with the Hazardous <br /> Building Statute. The UBC has to be followed, basically without amendment, throughout the <br /> State. Thus, while Section 6-18 of the Arden Hills Code allows abatement pursuant to the <br /> I UCADB, it is preempted by the UBC, and; therefore, the City has to pursue abatement pursuant <br /> to the Hazardous Building Statute. <br /> I A definition of what constitutes a "hazardous building" pursuant to the Hazardous Building <br /> Statute is refereed to in the Proposed findings and Order. <br /> I Findings and Order <br /> The proposed findings contain a list of 15 itcms. In itcm # I of the findings and Ordcr, I was <br /> I told by Steve Nixon that both of his parents had died and that he was now the owner or contact <br /> person for the property at 1369 forest Lane. In items 2-15 of the Findings and Order,] have <br /> found all of these conditions to exist at 1369 forest Lane. I have included photographs of the <br /> I property (exhibit E) taken on September 5,1997, during a meeting with Steve Nixon. I believe <br /> these photos will help substantiate the conditions identified in the Findings and Order. <br /> -: Abatement Process <br /> The Hazardous Building Statute sets forth the abatement proceedings. Staff will work closely <br /> with the City Attorney in regards to the proper procedures to be taken in order to be in full <br /> I compliance with all rules and regulations. <br /> I Budget Impact <br /> At this time, Staff is only requesting authorization to begin commencement of abatement <br /> proceedings at 1369 forest Lane. Staff estimates cost shall be minimal, basically for Staff costs <br /> I relating to preparing the findings and Order, the resolution, and lawyer fees in preparing and <br /> consultation for the above items. <br /> I Only after the order has been served and the appropriate time has elapsed with no response will <br /> Staff pursue this matter further. This most likely will entail. <br /> I 1. Procuring three (3) estimates for the abatement of the hazardous conditions identified in <br /> exhibit A the findings and Order. <br /> 2. Obtaining a market evaluation of the home. <br /> I 3. Making a determination based on the home value whether the home should be renovated <br /> or demolished based on the market analysis of what the home may be worth. <br /> I <br /> wi <br /> I <br /> - --- --- ,--- <br />
