<br /> -,-,-------- - ----- <br /> I <br /> On August 13, 1997, the City sent another letter (exhibit C 4) to Mr. Nixon indicating no contact , <br /> or abatement of violations had occurred and the property owner had lmtil August 22,1997, to <br /> contact the City or legal action would be commenced. <br /> On August 25, 1997, Mr. Nixon contacted me and informed me that he had been out of town <br /> three (3) to four (4) weeks and was unaware of the August 13, 1997, letter. At that time, I was I <br /> told by Mr. Nixon that he had a meeting on August 28, 1997, with his insurance company <br /> concerning a possible settlement of the fire damage. I than asked Mr. Nixon ifhe was the owner <br /> of the property. He indicated to me that both of his parents died, and that yes he now was the I <br /> contact person for the property. <br /> The City sent a letter to Mr. Nixon on August 26,1997, (exhibit C 3) indicating the City wanted I <br /> a meeting to occur no later than September 5, 1997. <br /> On September 2, 1997, Mr. Nixon called and arranged a meeting for September 5, 1997, at that I <br /> timc, I was ablc to obtain entry into the homc, and takc pictnrcs (exhibit E) of both thc interior <br /> and exterior of the property. I was able to confirm that in the homes current condition that it was I <br /> unsafe and uninhabitable. I was told by Mr. Nixon that nobody was currently living in the home; <br /> although, I had neighbors call indicating otherwise. I told Mr. Nixon the house definitely was <br /> uninhabitable, no one may be living in it, and that both the exterior and interior needed to be I <br /> abated as soon as possible. Thc reasons for this determination are based on the Findings and <br /> Orders (exhibit A), making the home unsafe for human habitation. <br /> Mr. Nixon informed me of another meeting with his insurance company on September 10, 1997. ~ <br /> Mr. Nixon stated he would contact me with the resnlts of that meeting by September 12, 1997. <br /> On September 15 and 17, 1997, I tried to contact Mr. Nixon at the phone number he gave me I <br /> during our September 5, 1997, meeting. On September 18, 1997, 1 called again and sent a letter <br /> (exhibit C I) to Mr. Nixon indicating the City would again begin whatever legal action necessary <br /> to abate these conditions. The City also stressed Mr. Nixon needed to contact the City to discuss I <br /> a reasonable timetable to abate the property. I again tried to contact Mr. Nixon by phone on <br /> October 8, 1997, and was able to leave a voice message indicating he needed to contact the City. <br /> On October 20, ] 997, while doing a follow-up investigation of the property, I was again able to I <br /> talk to Mr. Nixon by chance as he happened to be outside of the home. 1 indicated he needed to <br /> be in contact with the City, and that the City was going forward with plans to abate the I <br /> conditions in violation of City code. Mr. Nixon then told me that his insurance company still <br /> had not made any determination and that is why he has not contacted the City. I then told him <br /> that it is in everybody's best interest to have either the insurance company or their attorney to I <br /> contact our City Attorney, so that maybe something can be worked out to abate the conditions in <br /> the following Findings and Order. As of this \"Titing the City has yet to hear from Mr. Nixon. I <br /> have enclosed copies of all correspondence with Mr. Nixon for reference (exhibit C 1). I <br /> Code Items <br /> The following is a brief summary of the codes indicating the authority that allows for the City to I <br /> declare the building a "hazardous building" and unfit for human habitation. Section 102 from <br /> 1994 UBC states all unsafe buildings, structures, or appendages are hereby declared to be public '- <br /> nuisances and shall be abated in accordance with the procedures set forth in Sections 463.15 to <br /> I <br /> --- ---------,---- <br />
