Variance <br /> The Bergquist variance request, which was reviewed at the October 1, <br />I 1997 Planning Commission meeting and was to have been reviewed by the <br /> Council this eyening, has been withdrawn by the applicant. <br />I c. Res. #97-53. Authorizin!! the Commencement ofProceedin!!s under <br /> Minnesota Statute 463.15. ET. SEO. Relative to 1369 Forest Lane <br />I The City Council is asked to adopt Resolution #97-53, authorizing the <br /> commencement of proceedings under Minnesota Statute 463.15, ET. SEQ., <br /> relative to 1369 Forest Lane. This action would allow for the City to begin the <br />I abatement on 1369 Forest Lane, and direct the City Attorney and Building <br /> Ot1lCi3! to undertake all necessary actions related to this abatement. This homc <br /> was damaged by lire earlier this summer. The City has attempted to get the <br />I property cleaned up with no success. The approval of this action would allow the <br /> City to begin formal abatement proceedings to get the property cleaned up. <br />I d. Res. #97-52. Opposing Legislation Providing a l'ublic Subsidy for <br /> Construction of Additional Professional Sports Facilities <br /> The City Council is asked to adopt Resolution #97-52, opposing legislation <br />.. providing a public subsidy for construction of additional professional sports <br /> facilities. This resolution is presented to the City Council at the request of <br /> Senator Linda Runbeck. <br />I e. Ordinance No. 302. Amending Cable Franchise Ordinance No. 226. Article <br />I II. Section 4. Franchise Term <br /> The City Council is asked to adopt Ordinance No. 302, amending Cable Franchise <br /> Ordinance No. 226, Article II, Section 4, Franchise Term. The adoption of this <br />I ordinance extends the term of the existing franchise agreement several months. <br /> This is the period of time expected to be necessary to have the new franchise <br /> agreement resolved. <br />I 4. Department Report <br /> The City Council will find the department report enclosed for each of the various City <br />I Departments. Activities related to the Administration Department include: <br /> a. General Administration <br />I l. Midwest Asphalt Case <br /> Staff participated in several meetings, depositions and pre-trial <br />~ conferences regarding the Midwest Asphalt litigation. The case is <br /> expected to go to trial in November. <br />, <br />
