<br />I' -l>:':;.- 'r "'T<','Gi <br /> , ,"'. -.';"-~~- <br /> J ~ -: <br /> ;~ ';i1t~liI,,";~ <br />I <br />" CITY OF ARDEN HILLS <br /> MEMORANDUM <br />I DATE: November 10, 1997 <br /> TO: Mayor and City Council <br />I FROM: Kevin Ringwald, Community Development Director ~ <br />I SUBJECT: Resolution 97-55, Vacating a portion of the 14th Avenue Northeast <br /> right-of-way <br />I Introduction <br /> The Staff requests that the City Council endorse Resolution 97-55 vacating a portion of the 14th <br />I A venue Northeast right-of-way (Exhibit A), <br /> Back~round <br />I As the City Council will remember, part of the approvals of Planning Case 97-06 involved the <br /> vacating of a portion of the 14th Avenue Northeast right-of-way (Exhibit B). The vacation <br /> procedures for this action were taken as part of the Planning Commission recommendation of <br />.. July 2, 1997 and the City Council approval of September 22, 1997. The replatting process for <br /> the redevelopment of this area would technically vacate and replat the necessary roads all at the <br />I same time. However, based on the number of participants in this redevelopment process and its <br /> complexity, it is now felt a resolution vacating the right-of-way would eliminate any questions <br /> from these various participants prior to the questions arising. <br />I As before, the City does not wish to vacate the right-of-way until it is assured that the new right- <br /> of-way will be in place. Therefore, the resolution and the plat should be filed consecutively so <br />I that no gaps in access will occur and the ownership of the right-of-way for Gateway Boulevard <br /> should be transferred to the City. <br />I Recommendation <br /> The Staff recommends adoption of Resolution 97-55, vacating a portion of the 14th Avenue <br /> Northeast right-of-way, subject to this resolution being consecutively filed with the recording of <br />I the Plat of Gateway Addition (as approved in Planning Case 97-06) and the ownership of the <br /> replacement right-of-way (Gateway Boulevard) being transferred to the City. <br />I <br />I <br />~ <br />I <br />
