<br />I' ~~6rr .4 '7 <br />I STATE OF MINNESOTA <br />~ <br /> COUNTY OF RAMSEY <br /> CITY OF ARDEN HILLS <br />I RESOLUTION 97-55 <br /> RESOLUTION VACATING A PORTION <br />I OF THE 14TH AVENUE NORTHEAST RIGHT-OF-WAY <br /> IN THE GATEWAY BUSINESS DISTRICT <br />I WHEREAS, the City of Arden Hills (the City) established the Gateway Business District (the <br /> GBD) in 1988 to redevelop the area generally located at the northeast corner of Interstate 35W <br /> and Interstate 694; and <br />I WHEREAS, the City has been working with Welsh Development Company (the Developer) on <br />I redeveloping the northern portion of the GBD; and <br /> WHEREAS, the Developer has requested, as part of Planning Case 97-06, to vacate a portion of <br />I the 14th Avenue Northeast right-of-way, as described in Exhibit A, which would facilitate <br /> redevelopment within the GBD; and <br />.. WHEREAS, the petition to vacate said easement was made by the Developer and the City has <br /> caused a notice of public hearing to published in the City's official newspaper for two (2) <br /> consecutive weeks (June 18 and 25,1997) and the City has notified the affected property owner <br />I at least ten (l0) days prior to the public hearing; and <br /> WHEREAS, the request to vacate was reviewed by the Arden Hills Planning Commission at a <br />I public hearing on the 2nd day of July, 1997 and approved by the Arden Hills City Council on <br /> 22nd of September, 1997; and <br />I WHEREAS, it is the intent of the City and the Developer to relocate the functions of the <br /> existing 14th Avenue Northeast onto Gateway Boulevard as shown in the approvals of Planning <br />I Case 97-06; and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />I Minnesota hereby agrees to the vacation of that portion of the 14th Street right-of-way as <br /> described on Exhibit A, subject to this resolution being consecutively filed with the recording of <br /> the Plat of Gateway Addition (as approved in Planning Case 97-06) and the ownership of the <br />I replacement right-of-way (Gateway Boulevard) being transferred to the City. <br />I <br />it <br />I <br />
