<br /> I <br /> I <br /> f' FAMILY AND MEDICAL LEAVE <br /> In accordance with the federal Family and Medical Leave Act (FMLA), unpaid job <br /> I protected leave will be granted to all eligible employees (male and female) for up to <br /> twelve (12) weeks per twelve (12) month period for any of the following reasons: <br /> I 1. Birth, adoption or foster care placement of a child; <br /> 2. To care for a spouse, child or parent who has a serious health condition; <br /> I or <br /> 3. For a serious health condition that makes the employee unable to perform <br /> I the functions of the position. <br /> Eliqibilitv <br /> I An eligible employee is one who has worked for the City for at least: <br /> I 1. 12 months, and <br /> 2. 1,250 hours during the twelve month period prior to requesting the leave. <br /> Ie Lenqth of Leave <br /> I The length of FMLA leave is not to exceed twelve (12) weeks in any twelve (12) month <br /> period, The entitlement to FMLA leave for the birth or placement of a child expires twelve <br /> (12) months after the birth or placement of the child. <br /> I Leave Year <br /> - <br /> I The leave year will commence the first day the employee is absent from work on FMLA <br /> leave. <br /> I Substitution of Paid Leave Time <br /> I An employee may request or the employer may require that an employee substitute <br /> accrued paid sick leave or vacation time for all or part of a family/medicalleave taken for <br /> any reason. <br /> I Notice <br /> I 1. The employee is to give notice at least thirty (30) days prior to the date on <br /> which leave is to begin or if thirty (30) days notice cannot be given, as <br /> " much notice as practicable. <br /> 2. If an employee fails to give thirty (30) days notice for a foreseeable leave <br /> I <br /> ------ <br />
