The City Engineer has reviewed the <br /> utility easement and detelmined that the portion needed for the driveway is excess <br /> and has no current or future use. However, thc City Council will need to hold a <br /> public hearing before any portion oflhe utility easement can be vacated. Ifthe <br /> preliminary plat is approved, it would need to be contingent upon the City <br /> Council approving a vacation of a portion of the utility easement. The City <br /> Council could hold a public hearing for the vacation when the preliminary plat is <br /> reviewed. <br /> A variance would be required for two lots to share a portion of a driveway and an <br /> access point. <br /> E. Park Dedication. Since this subdivision results in the creation of two new <br /> residential lots, the park dedication fee applies. Section 1130.08 of the City <br /> Subdivision Code states that all subdivisions are required to dedicatc a portion of <br /> their land for recrcation and conservation purposes.
