However, if the variance is <br /> approved, thc City Attorney did recommend that the applicant prepare a private agreement <br /> . for maintenance of the proposed shared driveway, <br /> The Fire Marshal's only comment was a request to havc the address for the remaining <br /> dwelling on proposcd Lot 4 changed from Ncw Brighton Road to Thorn Drive due to the <br /> chance in access points (Attachment 3C-2). The Building Official did not have any <br /> comments regarding this proposal. <br /> Findings of I<act <br /> Zottittg Ordittattce Findings: <br /> 1. The preliminary plat proposal meets or exceeds all of the requirements of thc <br /> underlying R-2 Zone, including minimum lot sizc, lot width, and lot depth. <br /> 2. All four lots in the preliminary plat arc capable of accommodating a dwclling that <br /> meets all required setbacks and coverage limits without a variance. <br /> Subdivisiott Ordinance Findings: <br /> 3. Thc proposed Lots mcct or exceed all of the requirements of the City of Arden Hills <br /> Subdivision Code, <br /> 4, All four lots are adjacent to the public right-of-way and capable of supporting <br /> separate driveways ifthc variance for a shared access point is denied. <br /> 5. A park dedication fec will be required for this subdivision proposal. <br /> . Variance Findittgs <br /> 6. The reasons for the variance are not particularly unique to the property. The variance <br /> is not based on a hardship unique to the lot size, dimensions, or topography. There <br /> does not appear to be any significant barriers to constructing separate driveways to <br /> New Brighton Road unless Ramsey County would require the two lots to share onc <br /> acccss point to New Brighton Road. <br /> 7. The Valiance would be within the spirit and intent of the Zoning Ordinance. <br /> Although the Zoning Ordinance requircs each lot to have a separate drivcway, a large <br /> portion of each driveway would be separate. It is unlikely that the sharcd portion of <br /> the driveway would negatively impact the neighborhood. <br /> 8. The property could be put to use without the variance; however, granting the variance <br /> may increase safety without negatively influencing the neighborhood, <br /> 9.
