Staff Recommendation . In Planning Case #06-013, Staff recommends approval ofthc preliminary plat based on the eight . findings of fact and submittcd plans. Provided that the City Council approves a partial vacation of the utility easement for the proposed driveway on Lot 3, the lots in the subdivision meet or exceed a1l of the requircments of the undcrlying R-2 Zone. While the rcqucsted variance is unlikely to have a negative impact on the adjacent properties or the City, Staff cannot recommend approval of the variance due to the lack of a bona fide hardship. The City has not received any comments from Ramsey County to determine if there is a prefcrence for one or two driveway access points to New Brighton Road for Lots I and 2. If the Planning Commission does recommend approval of the variance, findings supporting the approval should be cited. Once the preliminary plat is approved by the City, no additional conditions related to the design of the preliminary plat can be added. The final plat is simply a review process to ensure that the changes required in the preliminary plat have been made. Staff proposes the f01l0wing sixteen conditions if approval of the preliminary plat is recommended to the City Council: 1. Thc preliminary plat shall be contingent upon approval of a request to vacate a portion of the utility easement for the driveway on proposed Lot 3. 2. The applicant shall comply with applicable provisions of the City Code and related ordinances. 3. The applicant shall submit the final plat and application to the City of Arden Hi1ls within three months of the preliminary plat approval date or the approval shall expire . unless an extension is granted by the Planning Commission. The final plat sha1l reflect a1l changes req uired in the conditions of approval for the preliminary plat. 4. The project shall be completcd in accordance with the plans submitted as part of the preliminary plat application. Any significant changes to thesc plans, as determined by the City Planner, shall require revicw and approval by the Planning Commission. 5. The applicant shall inelude a 12 foot drainage and utility easement centcred on all common lot lines, and a 12 foot drainage and utility casement along the right-of-way. 6. The applicant shall pay a park dedication fee as determined by the City Council at the time the final plat is approved. 7. The applicant shall amend the final plat to be in conformance with all of the comments from the July 3,d, 2006, memo from the City Engineer. 8. Any extension of City services for the new lot shall be subject to review and approval by the City Engineer and a1l associated costs shall be the responsibility of the applicant. 9. Erosion control measurcs shall be installed before any grading or construction begins and shall be maintained and remain in place until groundcover is reestablished and construction is finishcd.
