<br /> Staff Recommendation . <br /> In Planning Case #06-013, Staff recommends approval ofthc preliminary plat based on the eight . <br /> findings of fact and submittcd plans. Provided that the City Council approves a partial vacation <br /> of the utility easement for the proposed driveway on Lot 3, the lots in the subdivision meet or <br /> exceed a1l of the requircments of the undcrlying R-2 Zone. <br /> While the rcqucsted variance is unlikely to have a negative impact on the adjacent properties or <br /> the City, Staff cannot recommend approval of the variance due to the lack of a bona fide <br /> hardship. The City has not received any comments from Ramsey County to determine if there is <br /> a prefcrence for one or two driveway access points to New Brighton Road for Lots I and 2. If <br /> the Planning Commission does recommend approval of the variance, findings supporting the <br /> approval should be cited. <br /> Once the preliminary plat is approved by the City, no additional conditions related to the design <br /> of the preliminary plat can be added. The final plat is simply a review process to ensure that the <br /> changes required in the preliminary plat have been made. Staff proposes the f01l0wing sixteen <br /> conditions if approval of the preliminary plat is recommended to the City Council: <br /> 1. Thc preliminary plat shall be contingent upon approval of a request to vacate a <br /> portion of the utility easement for the driveway on proposed Lot 3. <br /> 2. The applicant shall comply with applicable provisions of the City Code and related <br /> ordinances. <br /> 3. The applicant shall submit the final plat and application to the City of Arden Hi1ls <br /> within three months of the preliminary plat approval date or the approval shall expire . <br /> unless an extension is granted by the Planning Commission. The final plat sha1l <br /> reflect a1l changes req uired in the conditions of approval for the preliminary plat. <br /> 4. The project shall be completcd in accordance with the plans submitted as part of the <br /> preliminary plat application. Any significant changes to thesc plans, as determined <br /> by the City Planner, shall require revicw and approval by the Planning Commission. <br /> 5. The applicant shall inelude a 12 foot drainage and utility easement centcred on all <br /> common lot lines, and a 12 foot drainage and utility casement along the right-of-way. <br /> 6. The applicant shall pay a park dedication fee as determined by the City Council at the <br /> time the final plat is approved. <br /> 7. The applicant shall amend the final plat to be in conformance with all of the <br /> comments from the July 3,d, 2006, memo from the City Engineer. <br /> 8. Any extension of City services for the new lot shall be subject to review and approval <br /> by the City Engineer and a1l associated costs shall be the responsibility of the <br /> applicant. <br /> 9.
